YES NO lease explain below Budget line item number(s): , The Advisory Committee of the Whatcom County Lake Management District No. 1 passed a resolution and Lest that the County Council acting consider this resolution to extend the Lake Management District when it is necessary. to do so. The purpose of this resolution is to assure the Department of Ecology that the Lake Management District will be extended beyond the three year limitation if it is necessary. ORIGINATOR'S RECOMMENDED ACTION.• The Council, acting as the governing body of LMD 1, is requested to adopt this resolution. Related File Numbers: Ordinance or Resolution Number (this item only): Res 93 -053 termlim.res 07/01 /93 SPONSORED BY: Laidlaw PROPOSED BY: LMD Advisory Com INTRODUCTION DATE: July 7, 1993 1 RESOLUTION NO. 93 -053 2 TO ALLOW FOR THE EXTENSION OF TERM 3 LIMITS OF THE LAKE MANAGEMENT DISTRICT NO. 1 4 WHEREAS, the Whatcom County Lake Management District No. 1 Advisory 5 Committee for Lake Samish was established to bring together the various agencies and 6 citizen representatives to advise the .County Administration on its implementation of the 7 program and projects necessary to satisfy the aims of the District; and 8 WHEREAS, the Washington State Department of Ecology determined that water 9 withdrawal from Lake Samish created a negative impact on Friday Creek; and 10 WHEREAS, many Lake Samish residents were withdrawing water from the lake 11 without valid water rights permits; and 12 WHEREAS, the Department of Ecology agreed to issue water permits to current 3 users and for new construction contingent on the residents mitigating the impact of the 14 water withdrawal on Friday Creek; and 15 WHEREAS, many residents were concerned about frequent flooding during periods 16 of rapid runoff; and 17 WHEREAS, the Whatcom County Lake Management District No. 1 was formed 18 expressly for the purpose of stream mitigation and flood control for the period not to exceed 19 three years; and 20 WHEREAS, there is currently a public water system being considered for the Lake 21 Samish area; and 22 WHEREAS, the timing of the end of the Lake Management District No. 1 may not 23 coincide with the completion or rejection of the public water system; 24 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council acting 25 as the Lake Management District No. 1 Board that the Lake Management District No. 1 26 will be extended beyond the three year limit when it becomes apparent that an extension 27 up to, but not beyond, the ten year limit allowed by law is necessary to meet the 28 augmentation requirements set by the Department of Ecology; Page 1 1 BE IT FURTHER RESOLVED that this extension will not continue when, and if, 2 a public water system is in place nor will it involve the additional collection of funds. 3 APPROVED this 27th day of July , 1993. 4 LAKE MANAGEMENT DISTRICT NO. 1 BOARD 5 ATTEST: WHATCOM COUNTY, WASHINGTON 6 7 Ramona Reeves, Council Clerk .1�4arge T aidlai_ Council Chair - d� 8 APPROVED AS TO FORM AND CONTENT: 9 �. 10 Civil Deputy P Yi tifijLAtty.
