YES NO Please explain below Budget line item numbers): The Council authorized a pay increase for the Board of Equalization members when it adopted the 1992 budget. Staff should have then prepared an ordinance amending the Whatcom County Code to reflect the change in daily r • for the Board members; however, this was never done. An employee of the State Auditor's Office brought t.-- oversight to our attention in June 1993. The Clerk of the Council feels very strongly that the Board of Equalization members should not be penalized for an administrative, error, particularly when they performed their duties in 1992 and to date in 1993 with the understanding that they were entitled to $75 per day in compensation. Civil Deputy Prosecutor Dan Gibson recommended that we prepare a resolution for Council's consideration which would forgive the overpayment to Board Members. *This is a companion resolution to the ordinance amending Whatcom County Code 2.21, filed under AB93 -224. ORIGINATOR'S RECOMMENDED ACTION.- The Clerk recommends that the Council pass the resolution. COMMITTEE ACTION TAKEN COUNCIL ACTION TAKEN: 7/27/93: Council approved the resolution. 6 -0 Related File Numbers: Ordinance or Resolution Number (this item only): Res 93 -052 boepay.res 616/93 SPONSORED BY: consent AB93 -224A PROPOSED BY: Clerk of the Council INTRODUCTION DATE: July 13, 1993. 1 RESOLUTION NO. 93 -052 2 REGARDING BOARD OF EQUALIZATION MEMBERS' 3 PAY INCREASES AS AUTHORIZED IN 1992 4 WHEREAS, the Whatcom County Council authorized an increase in the per -day pay 5 for members of the Board of Equalization, from $55 to $75 per day, when it adopted the 6 1992 budget for Whatcom County; and 7 WHEREAS, due to an administrative oversight an amendment was not made to 8 Whatcom County Code Section 2.21, which still indicates the per day rate of pay is $55; and 9 1 WHEREAS, the Council is being asked to adopt such an amendment as soon as I possible; and 11 WHEREAS, the Council clearly authorized the pay increases to take effect in 1992, 12 the Board members have been paid at the rate of $75 per day since 1992; and 13 WHEREAS, it would be burdensome and unfair for the Board members to be 14 penalized by having to repay a portion of their salaries as a result of this error, particularly 15 when they performed their duties in good faith and with the understanding that they were 16 to be paid $75 per day; 17 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it 18 is the Council's intent to forgive the overpayment of Board of Equalization members' 19 salaries in 1992 and 1993; and Page 1 1 BE IT FURTHER RESOLVED that the County Auditor, the County Treasurer, and 2 the State Auditor's Office shall receive a copy of this resolution upon its passage by the 3 Council. 4 APPROVED this 27th day of July , 1993. 5 6 ATTEST: 7 ZL 8 Ramona Reeves, Council Clerk 9 APPROVED as to form & content: 11 Civil Deputy Pros.
