1 RESOLUTION NO. 93 -049
2 DECLARING LEGISLATIVE INTENT REGARDING CONDITIONAL USE
3 PERMITS FOR STRINGING CABLE TELEVISION LINE ON EXISTING POWER
4 POLES
5 WHEREAS, Whatcom County Code 20.82.020 lists "trunk utility lines" as among
6 activities requiring a conditional use permit: and
7 WHEREAS, the legislative intent in that section was to require such permits for new
8 pole -line construction (the section makes reference to new "structures "), not for stringing
9 cable on existing poles; and
10 WHEREAS, the requirement that a conditional use permit be obtained for stringing
11 television cable on existing power poles is adversely affecting Whatcom County residents
12 who wish cable television service.
_3 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it
14 is the legislative intent of the Council that the conditional use permit section of WCC
15 20.82.020 not apply to stringing television cable on existing, permitted, power poles.
