The Pollution Liability Insurance Agency contacted the Kendall Grocery and advised them that they are likely
el -ible for grant funding to replace their underground gasoline tanks. A letter from the Kendall Volunteer Fire
1 )artment indicates that the department purchases gasoline for their fire equipment from the applicant, and
will negotiate a cost -plus agreement for supply. This appears to meet the state guidelines that require that the
operator provides a "...vital local government, public health, or safety need..." Other government agencies,
including Whatcom County, also use the services of the business. The resolution certifies to the state the service
provided by the applicant.

2 ENDORSEMENT OF GRANT APPLICATION FOR
3 KENDALL GROCERY
4 WHEREAS, the Whatcom County Council has reviewed information supplied by
5 Kendall Grocery in application for a grant relating to upgrading of fuel storage tanks; and
6 WHEREAS, the Council finds that Carolee Tracy certifies that she is the owner and
7 operator of Kendall Grocery; and
8 WHEREAS, the County Council finds that other retail petroleum product retailers
9 are located remote from the community around Kendall; and
10 WHEREAS, the Kendall Volunteer Fire Department has indicated that Kendall
11 Grocery is their local source of supply for fuel; and
12 WHEREAS, James Phy, Sr. Chief of the Kendall Volunteer Fire Department has
13 been designated as the person responsible for negotiating a cost -plus basis agreement with
14 the applicant, if successful in receiving grant assistance, so that the fire district can purchase
15 petroleum products under that agreement; and
16 WHEREAS, the seventeen years that the existing ownership has operated the station
17 provides evidence that the applicant is capable of fulfilling the agreement required by the
18 state of Washington for providing financial assistance; and
19 WHEREAS, the County Council finds that the applicant, by selling petroleum
20 products in the Kendall area to the fire department, meets a vital public safety need;
21 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that
22 certification is hereby provided to the state of Washington that Kendall Grocery should be
23 considered for financial assistance to be used for corrective action and repair, replacement,
24 reconstruction, and improvement of its underground petroleum storage tank(s) and tank site.
25 The completion of the attached certification form is a good faith effort on the part of
26 Whatcom County to certify that the continued operation of Kendall Grocery petroleum
27 underground storage tanks meets a vital local, public health or safety need. This certification

2 Kendall Grocery remains responsible for fulfilling all laws, ordinances and regulations in
3 effect at the time that work commences at the underground storage tank site.

Part 2 must be completed by an official of the local government entity that has jurisdiction over
the location of the applicant business site.
Any local official who has an ownership interest in, or operates a petroleum retail business that
is applying for grant assistance under this program should take no part in the decision of this
certification.

Applicant will sell gas to the Kendall Volunteer Fire Department. The
fire departmentstates that the businesshas been their source of supply
for 24 years. Letter attached.
( "Vital local government, public health, education or safety need" means an essential
or indispensable services provided by government for citizens. For example: fire
protection, law enforcement patrols, ambulance service, school buses or road
maintenance.)
3. List all local, state and federal government entities that you are aware of within this
jurisdiction that own or operates petroleum underground storage tanks. Include, if
possible, the number and size of the tanks, as well as the types of petroleum products
available at each site:
A list of all known tanks in the county was provided in September of
1992 to your agency. Please contact us if an additional copy is
required.
4. If the applicant business did not sell petroleum products, what would be the impact?
Where would local, state and federal government entities in this area purchase petroleum
products?
There is a second station in the immediate vicinity. The nearest
other service would be 6 miles, one way.
5. Provide the name, address and approximate distance from the applicant business of all
known petroleum retail outlets that are located within 10 road miles of the applicant
business. Include type of service each outlet provides (full service, self- service,
cardlock, etc.) Ther is a BP station approx. 150 yards from the applicant
with 6 self- service pumps. The nearestoother station is a Texaco station
at the corner of Mosquito Lake Rd. and the Mt. Baker Highway, a three
pump station. It is located 6 miles south of the applicant.
S. If a grant is awarded to this applicant business, the applicant must agree to maintain this
business as a petroleum retail outlet for a period of fifteen (15) years. In your judgment,
is the applicant business owner or operator capable of fulfilling such an agreement?

The building has been in use since 1906. The current owner /applicant
has owned th.e.property since 1976 and states that it is her intention
to remain in business into the future. There is no current indication
that the property will not remain in the petroleum sales business.
7. If a grant is awarded to this applicant business, a local government official must negotiate
an agreement with the applicant business so that local government entities are able to
purchase petroleum products on a cost -plus basis. Provide the following information
about the individual who will negotiate the cost -plus purchase agreement with the

None known at this time. The business is zoned in a commercial classification,
and has been at the current site for many years. No changes are currently
anticipated,

For the past 24 years, the Kendall Volunteer Fire Department has obtained their
gasoline for the fire equipment. At this time, we have two (2) trucks that
run on gasoline, and several small engines, (i.e. generator, power saw,) that
also needs gasoline to run on.
At the current time, we are negotiating with the store to obtain our gasoline
for cost plus.
