Ordinance or Resolution Number (this item only): R93 -025 SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE: April 13, 1993 1 RESOLUTION NO. 93 -025 2 TO SELL COUNTY TAX -TITLE PROPERTY 3 REQUEST NO. 76 4 WHEREAS, R.C.W. 84.64.270 allows the County to sell real estate acquired by tax 5 foreclosures where it is found to be in the best interest of Whatcom County to sell the same; 6 and, 7 WHEREAS, Whatcom County Council does deem it to be in the County's best 8 interest to sell the following listed parcels; and, 9 Recommended 10 Parcel Number Assessed Value Taxes & Costs Minimum Bid 11 370429 - 212127 $3,000.00 $981.44 $2,000.00 12 370429- 212153 1,500.00 858.82 (Included in above 13 (to be sold as a group) $2,000 amount) 14 380125- 445198 1,000.00 589.36 750.00 5 400429 - 434382 650.00 unknown 688.00 6 400429 - 434402 550.00 unknown (Included in above 17 (to be sold as a group) $688 amount) 18 WHEREAS, the Whatcom County Property Management Committee has 19 recommended the sale of the subject properties at no less than the recommended minimum 20 bid amounts indicated above; and, 21 WHEREAS, the Whatcom County Code as well as the state law allows the County 22 to reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources 23 if the Council finds that it is in the best interest to reserve these; and, 24 WHEREAS, the Whatcom County Council has determined that it is in the best 25 interest of the County to sell said properties subject to a restrictive covenant allowing for 26' imposition of community association fees; and, 27 WHEREAS, R.C.W. 84.64.270 requires the Council to establish minimum prices for 28 said units of tax -title properties and to determine whether or not a contract will be allowed 29 or if it will be a cash price; and, 30 WHEREAS, the assessed value of said properties, taxes and foreclosure cost amounts 31 and the recommended minimum bids are outlined above and that these minimum bids are 32 low enough not to accept contract on these prices but would be in the County's best interest 33 and the Council would require that these amounts be paid in cash; REQUEST 76 PAGE 1 34 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it 35 is in the best interest 'of the County to sell the above parcels for the recommended minimum 36 prices itemized above, plus costs and further in this sale transferring to the owners all coal, 37 oil, gas, gravel, minerals, ores, fossils, timber or other resources on or in said land and the 38 right to mine for and remove the same in conformity with zoning regulations in force and 39 effect; 40 BE IT FURTHER RESOLVED that said properties shall be sold subject to the 41 restrictive covenant allowing for imposition of community association fees as set forth in 42 Whatcom County Resolution No. 88 -37; 43 BE IT FURTHER RESOLVED that this sale shall be subject to the certification of 44 the County Treasurer. The committee has made exceptions to this rule for four parcels which are in the enclosed resolutions. The reasons for these exceptions are as follows: Parcels 370429 - 212153 and 370429- 212127 (a group of two) are assessed at $3,375.00 for both. The committee recommends accepting a bid offer of $2,000.00 on them. This is because there is a possibility that a large amount of back -fill is needed. These parcels were recently acquired through tax foreclosure and the committee sees no reason to keep them. Parcels 400429 - 434402 and 400429 - 434382 (a group of two) are assessed at $1,200.00 for both. The committee recommends accepting a bid offer of $688.00 on them. This is because they are tax -title parcels that have been in our inventory since 1910. They are very small parcels and the committee sees no reason to keep them. BJC /er
