YES / / NO / / lease explain below Budget line item number(s): In offering a grant for funding Cedarville Landfill closure improvements, DOE required Whatcom County to pass an ordinance or resolution acknowledging its obligation to fund post - closure activities by budgeting annually sufficient monies to cover costs up to $100,000 per year. County Council approval COMMITTEE ACTION TAKEN: COUNCIL ACTION TAKEN: 4/13/93: Council approved the resolution. 7 -0 Related File Numbers: Ordinance or Resolution Number (this item only): R93 -022 1 2 3 RESOLUTION NO. 93 -022 SPONSORED BY: Consent PROPOSED BY: Public Works INTRODUCED: 4/13/93 A RESOLUTION ESTABLISHING FINANCIAL ASSURANCE FOR POST CLOSURE OF CEDARVILLE LANDFILL 4 WHEREAS, Washington Administrative Code (WAC) 173 - 304 -467 requires a Financial 5 Assurance Account (FAA) for closure and post - closure costs for all landfills operated past November 27, 6 1989; and 7 WHEREAS, Whatcom County must fund post - closure activities identified in the current post- 8 closure plan for the Cedarville Landfill through an annual budget process; and 9 WHEREAS, the latest revised 20 -year post - closure cost estimate is $3.2 million based on the 10 approximate annual amount of $160,000 as budgeted in 1993; and 11 WHEREAS, WAC 173 - 304- 467(6)(a) requires a post - closure FAA to be generated at each facility 12 by transferring a percentage of the facility user fee; and 13 WHEREAS', WAC does not fit the situation where a landfill operated a very short time following 14 the mandate for an FAA; and 15 WHEREAS, the Washington State Department of Ecology has authority to approve other methods 16 for post - closure accounts under WAC 173 - 304 - 467(5); and 17 NOW, THEREFORE, BE IT RESOLVED that Whatcom County wants to comply with the intent 18 of the law; and i9 BE IT FURTHER RESOLVED that Whatcom County acknowledges its obligation to fund post- 20 closure activities in the amount of up to $160,000 per year and that it will make every effort to fund 21 necessary post - closure costs exceeding this figure; and 22 BE IT FURTHER RESOLVED that the funds for Cedarville Landfill post - closure activities will 23 be budgeted annually into the Solid Waste Management Fund and post - closure costs be billed to and paid 24 from the Fund. 25 APPROVED this 13th day of April , 1993. 26 ATTEST: WHATCOM COUNTY COUNCIL 27 WHATCOM COUNTY, WASHINGTON 28 w �� 29 Council Clerk Marge dlaw, Chairperson 30 31 32 33 APPROVED AS TO FORM: Civil Deputy Prosecuting Attorney
