SUMMARY STATEMENT:
This resolution requests the Department of Natural Resources to reconvey title for Forest Board lands recently acquired from
Trillium Corporation on Chuckanut Mountain to Whatcom County. In 1992 the Sate Legislature appropriated $500,000.00 to
the State Parks Budget to begin the purchase of portions of the Chuckanut Mountain property from the Trillium Corporation.
This appropriation is subject to Whatcom County acquiring a majority of the ownership of the forest board lands as provided
.or under RCW 76.12.072, reconveyance of forest board lands for use as a public park. This transaction is part of the larger
county -wide land exchange with the Trillium Corporation. This resolution, with the accompanying application for
reconveyance, will allow the reconveyance to proceed, fulfill the legislative requirement of county ownership of a majority
of the recently traded forest board lands, and thus release the appropriated funds to State Parks for the purchase of other
portions of the Chuckanut property.

A RESOLUTION REQUESTING THE RECONVEYANCE OF CERTAIN FOREST BOARD LANDS
ON CHUCKANUT MOUNTAIN FROM THE DEPARTMENT OF NATURAL RESOURCES TO
WHATCOM COUNTY AS PER RCW 76.12.070
WHEREAS, Whatcom County, the Department of Natural Resources, the Trust for Public Lands, The
Whatcom County Land Trust, the Washington State Parks and Recreation Commission, and the Trillium Corporation
have successfully concluded negotiations for the exchange, sale, and gift of certain forest lands in Whatcom County
including 800 acres on Chuckanut Mountain; and
WHEREAS, it has been agreed by all parties that the forest lands to be exchanged and purchased on
Chuckanut Mountain are to be managed primarily for recreation purposes; and
WHEREAS, Washington State Law allows for counties to request reconveyance of Forest Board lands from
the State of Washington for public park use (RCW 76.12.070) ; and
WHEREAS, the Washington State Legislature appropriated $500,000.00 to the State Parks Budget for
purchase of a portion of the Trillium property located adjacent to Larrabee State Park on Chuckanut Mountain
subject to Whatcom County acquiring the majority of the Forest Board lands north and adjacent to Larrabee State
Park through reconveyance of state forest lands back to county under RCW 76.12.072 (see Exhibit "A "); and
WHEREAS, the acquisition of these Forest Board lands by Whatcom County conforms to the Goals of the
Whatcom County Comprehensive Park and Recreation Open Space Plan and conforms with the Goals of the
Whatcom County Natural Heritage Plan.
NOW THEREFORE BE IT RESOLVED BY THE WHATCOM COUNTY COUNCIL:
1. Whatcom County determines that certain Forest Board lands located on Chuckanut Mountain are needed
by the county for public park purposes in accordance with adopted county recreation plans.
2. Whatcom County requests the Department of Natural Resources reconvey those Forest Board Lands on
Chuckanut Mountain as described in Exhibit "B ", the Application for Reconveyance of Forest Board Lands.

The appropriation in 'this subsection is
subject to the following conditions and
limitations:
(a) The appropriation in this subsection i3
provided solely for property acquisition, may not
be used to acquire development rights, and is
subject to chapter 43.99 RCW.
(b) Prior to the expenditure of any funds
provided from this subsection, Whatcom county
shall have acquired under forest board ownership
a majority of the•1200 -acre parcel of privately
owned land adjacent and to the north of Larrabee
state park. The county shall also have entered
into an agreement with the board-of natural
resources committing the county to manage these
lands, adjacent to Larrabee state park, as county
park land under RCW 76.12.072.
(c) Prior to the expenditure of any funds
provided from this subsection, either the city of
Bellingham or Whatcom county shall have made
application to the interagency committee for
outdoor recreation for funding available through
the wildlife and recreation program so that the
city or county may acquire park lands adjacent to
Larrabee state park. The application may provide
for management of the lands by the State Parks
and Recreation Commission.
(d) No additional state funds may be
expended for this acquisition Onless authorized
by the interagency committee for outdoor
recreation in accordance with. ;hapter 43.48A ACW.

The applicant understands and agrees to the following conditions:
1. The Department of Natural Resources' consideration of the
application includes a field inspection and an administrative
review to determine the impact the request will have on the
management of the lands involved, and to determine if the request
is in accordance with the statutes of the State of Washington and
policies of the Department of Natural Resources.
2. All reconveyances are subject to the approval of the Board of
Natural Resources.
3. If the reconveyance.is approved, conveyance of title will be by
quitclaim deed,'which includes provision for the Department of
Natural Resources to retain management of timber and mineral
resources, if any.
