2 REQUESTING FEDERAL COOPERATION IN RESEARCHING
3 NOOKSACK BASIN WATER ISSUES
4 WHEREAS, resolution of the status of water and water rights has been an area of
5 concern for well over 100 years to the people of Washington, state government and the
6 federal government; and
7 WHEREAS, processes are currently underway to attempt to reach a settlement
8 surrounding water issues and allocations involving the Lummi Tribe, Nooksack Tribe, State
9 of Washington and the United States government, along with various citizens, water
10 purveyors, cities and Whatcom County; and
11 WHEREAS, the collection of historical and scientific data will be crucial in resolving
12 the underlying policy questions; and
13 WHEREAS, the information to be amassed in this data collection operation is largely
14 from open public historical records, or will be un- biased scientific observations; and
15 WHEREAS, the collection of this data will result in great cost to the parties involved
16 and the separate, independent, collection of such data leads to a wholly unnecessary
17 duplication of cost to entities whose funding is derived from taxation, thereby requiring the
18 public to pay twice for the same information; and
19 WHEREAS, the information collected by the state and by Whatcom County is by law
20 open for public inspection and will available for inspection by the federal government; and
21 WHEREAS, is is clearly possible for interested parties to join with the federal
22 government to stipulate appropriate historical and scientific information that could be
23 gathered only once for all parties use, thereby avoiding unnecessary duplication and cost;
24 and
25 WHEREAS, it is the federal government that singularly refuses to consider such joint
26 action or to make their independent collection of the same historical and scientific data
27 available to the public;
28 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that we

I do hereby petition for immediate relief from this onerous and unwarranted duplication of
2 cost and effort and ask that the Executive and Legislative branches of the federal
3 government take steps as necessary to provide relief from this burdensome situation.
4 BE IT FURTHER RESOLVED, that this resolution be transmitted to the President
5 of the United States, the Speaker of the House of Representatives, the Majority Leader of
6 the Senate, the Secretary of the Interior, the Attorney General of the United States, the
7 Governor of the State of Washington, and the members of the Congressional and Senate
8 delegation from the State of Washington.
