1 RESOLUTION NO. 94-036
2 REGARDING PREPARATION OF THE PERMANENT CRITICAL AREAS
3 ORDINANCE FOR PRESENTATION TO THE COUNTY COUNCIL
4 WHEREAS, the Critical Areas Ordinance was introduced on May 12, 1992 and
5 finally adopted with amendments on June 23, 1992; and
6 WHEREAS, the County Council has approved several more recommendations made
7 by the Planning Commission regarding the development of permanent critical areas
8 regulations; and
9 WHEREAS, the citizens of Whatcom County approved referendum 93 -002 to repeal
10 certain portions of Ordinance 92 -032, the Temporary Critical Areas Ordinance; and
11 WHEREAS, the Council adopted an ordinance amending Title 20, 21 and the
12 Critical Areas Ordinance to include regulatory language that established the basis for
13 developing and administering the Stormwater Provisions of the Whatcom County
14 Development Standards;
15 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council
16 that the . Planning and Development Services Department shall prepare the permanent
17 Critical Areas Ordinance for presentation to the Council for introduction by the first
18 meeting in September, 1994; and

1 BE IT FURTHER RESOLVED that the Critical Areas Ordinance shall be compiled
2 by taking into consideration the citizens' referendum version and by working through areas
3 of contention and conflict that have arisen as a result; and
4 BE IT FINALLY RESOLVED that the Council intends to circulate the proposed
5 permanent Critical Areas Ordinance among citizens groups and to seek comment as
6 appropriate.
