The parcels numbers are: 400131 - 031326 -0226, 400131 - 031326 -0230, 400131 - 031326 -0284, 400131 - 031326 -0285, 410131 - 352245 -0000. For legal descriptions, please Exhibit "A" of attached resolution. ORIGINATOR'S RECOMMENDED ACTION: Following the hearing, the Treasurer recommends that the resolution be passed. Related File Numbers: Ordinance or Resolution Number (this item only): Res 94 -019 SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE: 3/22/94 1 RESOLUTION NO. 94 -019 2 TO SELL COUNTY TAX -TITLE PROPERTY 3 REQUEST NO. 94 -1 4 WHEREAS, R.C.W. 84.64.270 allows the County to sell real estate acquired by tax 5 foreclosures where it is found to be in the best interest of Whatcom County to sell the same; and, 6 WHEREAS, Whatcom County Council does deem it to be in the County's best interest to 7 sell the following listed parcels; and, 8 WHEREAS, the legal descriptions for the subject parcels are listed in the attached "Exhibit 9 A ", and the assessed value, taxes, foreclosure costs and the recommended minimum bids are as 10 follows: - 11 Recommended 12 Parcel Number Assessed Value Taxes & Costs Minimum Bid 13 400131 - 031326 -0226 $1,045.00 $905.21 $500.00 14 400131 - 031326 -0230 1,045.00 905.21 500.00 15 400131 - 031326 -0284 1,190.00 916.15 500.00 16 400131 - 031326 -0285 1,190.00 916.24 500.00 .7 410131 - 352245 -0000 1,750.00 unknown 1,750.00 18 WHEREAS, the Whatcom County Property Management Committee has recommended 19 the sale of the subject properties at no less than the recommended minimum bid amounts indicated 20 above; and, 21 WHEREAS, the Whatcom County Code as well as the state law allows the County to 22 reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the 23 Council finds that it is in the best interest to reserve these; and, 24 WHEREAS, the Whatcom County Council has determined that it is in the best interest of 25 the County to sell said properties subject to a restrictive covenant allowing for imposition of 26 community association fees; and, 27 WHEREAS, R.C.W. 84.64.270 requires the Council to establish minimum prices for said 28 units of tax -title properties and to determine whether or not a contract will be allowed or if it will 29 be a cash price; and, 30 WHEREAS, the assessed value of said properties, taxes and foreclosure cost amounts and 31 the recommended minimum bids are outlined above and that these minimum bids are low enough 32 not to accept contract on these prices but would be in the County's best interest and the Council 33 would require that these amounts be paid in cash; 34 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it is in 35 the best interest of the County to sell the above parcels for the recommended minimum prices 36 itemized above, plus costs and further in this sale transferring to the owners all coal, oil, gas, gravel, REQUEST 94 -1 PAGE 1 37 minerals, ores, fossils, timber or other resources on or in said land and the right to mine for and 38 remove the same in conformity with zoning regulations in force and erect; 39 BE IT FURTHER RESOLVED that said properties shall be sold subject to the restrictive 40 covenant allowing for imposition of community association fees as set forth in Whatcom County 41 Resolution No. 88 -37; 42 BE IT FURTHER RESOLVED that this sale shall be subject to the certification of the 43 County Treasurer. Once the Treasurer shall certify that the prices set forth for tax -title properties 44 in the Resolution are at least the amount of taxes, but not all foreclosure costs which are owed to the 45 County as provided for in R.C.W. 86.64.270, she shall direct the sale to take place; 46 BE IT FURTHER RESOLVED that said prices shall not be allowed under contract and 47 shall be paid in either cash, cashier's check, or money order to the Whatcom County Treasurer at the 48 time of sale; 49 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed 50 to sell such property at not less than a certified price and said sale shall take place in accordance 51 with the duties as established in R.C.W. 84.64.270. 52 APPROVED this 22nd day of March , 1994. 53 54 ATTEST: 55 56 57 Ramona Reeves, Council Clerk 58 APPROVED AS TO FORM: 5 9 &- 1' ,�_ t�193�--� 60 Civil Deputy Pros Atty.
