2 TO SELL COUNTY TAX -TITLE PROPERTY
3 REQUEST NO. 94 -1
4 WHEREAS, R.C.W. 84.64.270 allows the County to sell real estate acquired by tax
5 foreclosures where it is found to be in the best interest of Whatcom County to sell the same; and,
6 WHEREAS, Whatcom County Council does deem it to be in the County's best interest to
7 sell the following listed parcels; and,
8 WHEREAS, the legal descriptions for the subject parcels are listed in the attached "Exhibit
9 A ", and the assessed value, taxes, foreclosure costs and the recommended minimum bids are as
10 follows: -

18 WHEREAS, the Whatcom County Property Management Committee has recommended
19 the sale of the subject properties at no less than the recommended minimum bid amounts indicated
20 above; and,
21 WHEREAS, the Whatcom County Code as well as the state law allows the County to
22 reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the
23 Council finds that it is in the best interest to reserve these; and,
24 WHEREAS, the Whatcom County Council has determined that it is in the best interest of
25 the County to sell said properties subject to a restrictive covenant allowing for imposition of
26 community association fees; and,
27 WHEREAS, R.C.W. 84.64.270 requires the Council to establish minimum prices for said
28 units of tax -title properties and to determine whether or not a contract will be allowed or if it will
29 be a cash price; and,
30 WHEREAS, the assessed value of said properties, taxes and foreclosure cost amounts and
31 the recommended minimum bids are outlined above and that these minimum bids are low enough
32 not to accept contract on these prices but would be in the County's best interest and the Council
33 would require that these amounts be paid in cash;
34 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it is in
35 the best interest of the County to sell the above parcels for the recommended minimum prices
36 itemized above, plus costs and further in this sale transferring to the owners all coal, oil, gas, gravel,

37 minerals, ores, fossils, timber or other resources on or in said land and the right to mine for and
38 remove the same in conformity with zoning regulations in force and erect;
39 BE IT FURTHER RESOLVED that said properties shall be sold subject to the restrictive
40 covenant allowing for imposition of community association fees as set forth in Whatcom County
41 Resolution No. 88 -37;
42 BE IT FURTHER RESOLVED that this sale shall be subject to the certification of the
43 County Treasurer. Once the Treasurer shall certify that the prices set forth for tax -title properties
44 in the Resolution are at least the amount of taxes, but not all foreclosure costs which are owed to the
45 County as provided for in R.C.W. 86.64.270, she shall direct the sale to take place;
46 BE IT FURTHER RESOLVED that said prices shall not be allowed under contract and
47 shall be paid in either cash, cashier's check, or money order to the Whatcom County Treasurer at the
48 time of sale;
49 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed
50 to sell such property at not less than a certified price and said sale shall take place in accordance
51 with the duties as established in R.C.W. 84.64.270.
