YES / / NO / / (Please explain below) Budget line item number(s): n/a This resolution authorizes the donation of county owned property mineral rights to the Washington State Department of ural Resources, request # 78. The Whatcom County Council approved the donation of two parcels of real property, including timber rights, on July 13th, 1993 on resolution # 93 -047. The Department of Natural Resources has since requested that the mineral rights to these two parcels also be donated. The parcel numbers and legal descriptions of the parcels related to the mineral rights in question are: Parcel # 370630 - 173085, R/W FOR LOGGING RD ACROSS S 1/2 SW- SITUATE IN SECTION 30 TOWNSHIP 37 RANGE 6 EAST and Parcel # 370631 - 176341, R/W FOR LOGGING RD ACROSS GOVT LOT 2- SITUATE IN SECTION 31 TOWNSHIP 37 RANGE 6 EAST. ORIGINATOR'S RECOMMENDED ACTION.• Following the hearing, the Treasurer recommends that the resolution be passed. Related File Numbers: Ordinance or Resolution Number (this item only): Res 94 -015 1 SPONSORED BY: Consent 2 PROPOSED BY: Treasurer 3 INTRODUCTION DATE: 2/8/94 4 RESOLUTION NO. 94 -015 5 TO DONATE COUNTY OWNED PROPERTY 6 REQUEST 78 7 WHEREAS, R.C.W. 76.12.030 allows the County to donate real estate belonging to the 8 County where it is found to be in the best interest of Whatcom County to donate the same; and, 9 WHEREAS, parcels numbered 370630 - 173085 and 370631 - 076341, including timber on 10 these parcels, were approved for donation to the Washington State Department of Natural Resources 11 by the Whatcom County Council on July 13th, 1993, by resolution number 93 -047, and that this 12 donation reserved out coal, oil, gas, gravel, minerals, ores, fossils, or other resources on or in said 13 lands and the right to mine for and remove the same; and, 14 WHEREAS, The Department of Natural Resources has since requested that in addition to 15 the land and rights to timber, that Whatcom County also donate all coal, oil, gas, gravel, minerals, 16 ores, fossils or other resources on or in these two parcels; and; 17 WHEREAS, the Whatcom County Council does deem it in the best interest of the County 18 and the people thereof that all coal, oil, gas, gravel, minerals, ores, fossils or other resources on or 19 in parcels numbered 370630 - 173085 and 370631 - 076341 be donated to the Washington State 20 Department of Natural Resources; and; 21 WHEREAS, the Washington State Department of Natural Resources will provide the 22 necessary document(s) for transferring ownership and also will pay for all costs necessary for the 23 transfer of ownership; 24 WHEREAS, the Whatcom County Code as well as the state law allows the County to 25 reserve from the sale, coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the 26 Council finds that it is in the best interest to reserve these; and, 27 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County not 28 to reserve these mineral rights and by donation, transfer to the Department of Natural Resources all 29 coal, oil, gas, gravel, minerals, ores, fossils or other resources on or in said lands and the right to 30 mine for and remove the same in conformity with zoning regulations in force and effect; 31 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to 32 donate said mineral rights to the Washington State Department of Natural Rescources, said donation 33 shall take place in accordance with the duties as established in R.C.W. 76.12.030. 34 APPROVED this 1st day of March , 1994. 35 WHATCOM COUNTY COUNCIL 36 ATTEST: WHATCOM COUNTY, WASHINGTON -4�� :�L 3 7 Z- �-, _ 38 Ramona Reeves, Council Clerk Ro ert Imhof, C h 39 APPROVED AS TO FORM: 40 41 Deputy Prosecuting Attorney REQUEST NO. 78 PAGE 1
