Related File Numbers: Ordinance or Resolution Number (this item only): Res 94 -014 1 SPONSORED BY: Consent 2 PROPOSED BY: Treasurer 3 INTRODUCTION DATE: 2/8/94 4 RESOLUTION NO. 94-014 5 TO SELL COUNTY OWNED PROPERTY 6 REQUEST 79 7 WHEREAS, R.C.W. 36.34.010 allows the County to sell real estate belonging to the County 8 where it is found to be in the best interest of Whatcom County to sell the same; and, 9 WHEREAS, Whatcom County Council does deem it to be in the County's best interest to 10 sell the following described property: 11 Parcel No. 390421 - 544144, BEG 40 FT W FR SE COR OF NE SE -TH N 6 RODS - 12 TH W 8 RODS -TH S 6 RODS -TH E 8 RODS TO BEG -EXC PTN TO STATE FOR 13 HWY DESC AF 607254 -ALSO S 1/2 VAC RD 544 ABTG PER CVL 44012 - 14 SITUATE IN TOWNSHIP 39 SECTION 21 RANGE 4 EAST 15 also known as the Lawrence Township Hall; and, - 1.6 WHEREAS, the Whatcom County Code as well as the state law allows the County to 17 reserve from the sale, coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the 18 Council finds that it is in the best interest to reserve these; and, 19 WHEREAS, said parcel was appraised on September 8th, 1993 and the appraised value was 20 set at $11,500.00; and, 21 WHEREAS, the Whatcom County Property Management Committee has recommended that 2 the sale price should be set at $8,625.00, seventy -five percent of the appraised value; and, 23 WHEREAS, R.C.W. 84.64 requires the Council to establish the minimum price for said unit 24 of property and to determine whether or not a contract will be allowed or if it will be a cash price; 25 and, 26 WHEREAS, the Whatcom County Council deems that the amount of $8,625.00, is the 27 minimum price for said parcel and that it is low enough not to accept a contract on this price but 28 would be in the County's best interest and the Council would require that this amount be paid in 29 cash; 30 NOW, THEREFORE, BE IT RESOLVED that if is in the best interest of the County to 31 sell said parcel for the minimum bid of $8,625.00, plus costs, and further in this sale transferring to 32 the owner all coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources on or in said land 33 and the right to mine for and remove the same in conformity with zoning regulations in force and 34 effect; 35 BE IT FURTHER RESOLVED that said parcel shall be sold subject to the restrictive 36 covenant allowing for imposition of Community Association fees as set forth in Whatcom County 37 Resolution No. 88 -37; 38 BE IT FURTHER RESOLVED that this sale shall be subject to the certification of the 39 County Treasurer. Once the Treasurer shall certify that the price set in this Resolution is a 40 reasonable price for this property, she shall direct the sale to take place; 41 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and shall 42 be paid in either cash, cashier's check or money order to the Whatcom County Treasurer at the time 4.3 of sale; REQUEST NO. 79 PAGE 1 1 2 3 4 7 8 0 10 11 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to sell such property at not less than certified price and said sale shall take place in accordance with the duties as established in R.C.W. 36.34.010.
