2 TO SELL COUNTY OWNED PROPERTY
3 REQUEST NO. 95 -8
4 WHEREAS, RC.W. 36.34.0.10 allows the County to sell real estate belonging to the County
5 where it is found to be in the best interest of Whatcom County to sell the same; and,
6 WHEREAS, the Whatcom County Property Management Committee has recommended the
.7 sale of the subject property at no less than $1,099.31 and that sale is to be without warranty as to
8 the suitability of the subject property for any use or purpose; and,
9 WHEREAS, the Whatcom County Council does deem it to be in the County's best interest
10 to sell the following described property; and,
11 WHEREAS, Whatcom County Code as well as the state law allows the County to reserve
12 from the sale, coal,, oil, gas, gravel, mineral; ores, fossils, timber or other resources if the Council
13 finds that it is in the best interest of the County to reserve these; and,
14 WHEREAS, the Whatcom County Council has determined that it is in the best interest of the
15 County to sell said property subject to a restrictive covenant allowing for imposition of Community
16 Association fees; and,
17 WHEREAS, R.C.W. 84.64 requires the Council to establish the minimum price for said unit
18 of property and to determine whether or not a contract will be allowed or if it will be a cash price;
19 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to sell
20 parcel# 370407 - 436451 -0000 having legal description of. SUDDEN VALLEY DIV 2 LOT 88, to
21 the highest and best bidder, for no less than $1,099.31 plus costs, and further in this sale transferring
22 to the owner(s) all coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources on or in
23 said lands and the right to mine for and remove the same in conformity with zoning regulations in
24 force and effect, and that sale is to be without warranty as to the suitability of the subject property
25 for any use or purpose;
26 BE IT FURTHER RESOLVED that said lot shall be sold subject to the restrictive covenant
27 allowing for imposition of Community Association fees as set. forth in Whatcom County Resolution
28 No. 88 -37;
29 BE IT FURTHER RESOLVED that this sale shall be subject to the certification of the
30 County Treasurer. Once the Treasurer shall certify that the prices set in this Resolution are
31 reasonable prices for this property, she shall direct the sale to take place;

32 BE IT FURTHER RESOLVED that said prices shall not be allowed under contract and shall
33 be paid in either cash, cashier's check or money order to the Whatcom County Treasurer at the time
4 of sale;
35 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to
36 sell such property at not less than certified prices and said sale shall take place in accordance with
37 the duties as established in R.C.W. 36.34.010.
