This resolution authorizes the sale of county owned property, specifically parcel# 400125- 014514, also known as the Custer
.School Road Shop.

1 RESOLUTION NO. 95-0 5
2 TO SELL COUNTY OWNED PROPERTY
3 REQUEST NO. 95 -7
4 WHEREAS, R.C.W. 36.34.010 allows the County to sell real estate belonging to the County
5 where it is found to be in the best interest of Whatcom County to sell the same; and,
6 WHEREAS, the Whatcom County Property Management Committee has recommended the
7 sale of the subject property at no less than $46,500.00; and,
8 WHEREAS, the Whatcom County Council does deem it to be in the County's best interest
9 to sell the following described property; and,
10 WHEREAS, Whatcom County Code as well as the state law allows the County to reserve
11 from the sale, coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the Council
12 finds that it is in the best interest of the County to reserve these; and,
13 WHEREAS, the Whatcom County Council has determined that it is in the best interest of the
14 County to sell said property subject to a restrictive covenant allowing for imposition of Community
15 Association fees; and,
16 WHEREAS, RC.W. 84.64 requires the Council to establish the minimum price for said unit
17 of property and to determine whether or not a contract will be allowed or if it will be a cash price;
18 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to sell
19 parcel# 400125- 014514 having legal description of TR 208.71 FT E -W- 417.42 FT N -S IN NW
20 COR OF. NW 1 /4 -EXCL OF RD, to the highest and best bidder, for no less than $46,500.00 plus
21 costs, and further in this sale transferring to the owner(s) all coal, oil, gas, gravel, minerals, ores,
22 fossils, timber or other resources on or in said lands and the right to mine for and remove the same
23 in conformity with zoning regulations in force and effect;
24 BE IT FURTHER RESOLVED that said lot shall be sold subject to the restrictive covenant
25 allowing for imposition of Community Association fees as set forth in Whatcom County Resolution
26 No. 88 -37;
27 BE IT FURTHER RESOLVED that this sale shall be subject to the certification of the
28 County Treasurer. Once the Treasurer shall certify that the prices set in this Resolution are
29 reasonable prices for this property, she shall direct the sale to take place;

30 BE IT FURTHER RESOLVED that said prices shall not be allowed under contract and shall
31 be paid in either cash, cashier's check or money order to the Whatcom County Treasurer at the time
12 of sale;
33 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to
34 sell such property at not less than certified prices and said sale shall take place in accordance with
35 the duties as established in R.C.W. 36.34.010.
