This resolution authorizes the sale of county owned tax title property to the city of Bellingham,
rifically parcel number 380328 - 061426.

RESOLUTION NO. 95 -064
TO SELL PROPERTY ACQUIRED BY COUNTY
ON TAX FORECLOSURE
REQUEST NO. 95 -6
WHEREAS, R.C.W. 84.64.270 allows the County to sell real estate acquired by tax
foreclosure where it is found to be in the best interest of Whatcom County to sell the same; and,
WHEREAS, R.C.W. 84.64.320 allows for Tax Title property to be disposed of without bids
when the sale is to any governmental agency and for public purposes; and,
9 WHEREAS, the Whatcom County Property Management Committee has recommended the
10 sale of the subject property to the,City of Bellingham, Washington, at no less than the sum of taxes
11 owing plus any additional costs and liens at the time of foreclosure, or a negotiated price, whichever
12 is greater; and,
13 WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as negotiator in
14 such sales; and,
15 WHEREAS, the Whatcom County Treasurer has negotiated a sales price of $1,501.00; and
16 WHEREAS, R.C.W. 84.64 requires the Council to establish the minimum price for said unit
17 of property and to determine whether or not a contract will be allowed, or if it will be a dash price;
18 and,
19 WHEREAS, the Whatcom County Code as well as the state law allows the County to reserve
20 from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the Council finds
21 that it is in the best interest to reserve these;
22 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it is in the
23 best interest of the County to sell parcel #380328 - 061426 having legal description of THAT PTN
24 OF NW SW NW LY NELY OF CITY OF BELLINGHAM TRACT, to the City of Bellingham,
25 Washington, for the negotiated price of $1,501.00; and,
26 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and shall
27 be paid in either cash, certified check, or money order to the Whatcom County Treasurer at the time
28 of sale; arid,

29 BE IT FURTHER RESOLVED that this sale transfer to the owners all coal, oil, gas, gravel,
30 minerals, ores, fossils, timber or other resources on or in said land and the right to mine for and
l remove the same in conformity with zoning regulations in force and effect; and,
32 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to sell
33 such property at not less than a certified price and said sale shall take place in accordance with the
34 duties as established in R.C.W. 84.64.270.
