This resolution authorizes the sale of county owned tax title property, without bids,
enecifically parcel number 380224 - 107015.

RESOLUTION NO. 95-063
2 TO SELL PROPERTY ACQUIRED BY COUNTY
3 ON TAX FORECLOSURE
4 REQUEST NO. 95 -5 .
5 WHEREAS, R.C.W. 84.64.270 allows the County to sell real estate acquired by tax
6 foreclosure where it is found to be in the best interest of Whatcom County to sell the same; and,
7 WHEREAS, R.C.W. 84.64.320 allows for Tax Title property to be disposed of without bids
8 when the County legislative authority determines that it is not practical to build on the property due
9 to the physical characteristics of the property or legal restrictions on construction activities on the
10 property; and,
11 WHEREAS, the Whatcom County Property Management Committee has determined that it
12 is not practical to build on the property and recommends the sale of the subject property, at no less
13 than the sum of taxes owing plus any additional costs and liens at the time of foreclosure, or the
14 negotiated price, whichever is greater; and,
15 WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as negotiator in
16 such sales; and,
17 . WHEREAS, the Whatcom County Treasurer has negotiated a sales price of $150.00; and,
18 WHEREAS, R.C.W. 84.64 requires the Council to establish the minimum price for said unit
19 of property and to determine whether or not a contract will be allowed, or if it will be a cash price;
20 and,
21 WHEREAS, the Whatcom County Code as well as the state law allows the County to reserve
22 from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the Council finds
23 that it is in the best interest to reserve these;
24 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it is not
25 practical to build on parcel #380224 - 107015, having legal description of HOLLY ADD -BLK
26 1 -THAT PART LOT 2 -BEG ON LI BTWN LOTS 1 -2 18.1 FT N OF SE CDR SD LOT 2 -TH S
27 18.1 FT TO SE COR SD LOT 2 -TH NWLY ALG NLY LI ELDRIDGE AVE 2.5 FT -TH NELY
28 17.1 FT TO BEG, and it is in the best interest of the County to sell said parcel for the negotiated
29 price of $150.00; and,

30 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and shall
31 be paid in either cash, certified check, or money order to the Whatcom County Treasurer at the time
32 of sale; and,
33 BE IT FURTHER RESOLVED that this sale transfer to the owners all coal, oil, gas, gravel,
34 minerals, ores, fossils, timber or other resources on or in said land and the right to mine for and
35 remove the same in conformity with zoning regulations in force and effect; and,
36 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to sell
37 such property at not less than a certified price and said sale shall take place in accordance with the
38 duties as established in R.C.W. 84.64.270.
