To this end, the act requires the county to prepare an ADA transition plan that lists structural changes to facilities that will be undertaken to achieve program accessibility, and an ADA self evaluation plan to evaluate county services, policies and practices, identify barriers to program access, and take steps to modify them. This plan has been prepared by the Whatcom County ADA Coordinator under the auspices of the Whatcom County Department of Administrative Services. I. ADA DEADLINES AND WHATCOM COUNTY COMPLIANCE Required to be Steps Complete By Status 1. Designate a responsible employee January 26, 1992 Appointed Tom Sutberry ADA Coordinator June 22, 1992. Provide notice of ADA January 26, 1992 Provided to public and employees requirements in July 1992 during adoption of Ordinance 92-48, and in solicitation and appointment of ADA Compliance Committee in 1993. Also in November 1994 public hearing, and in 1995 self evaluation process. Notices posted on bulletin boards in every County facility April 1995. Front page article in Bellingham Herald newspaper April 4, 1995. Article in County Connection newsletter May 1995 'Message to Employees: Be Aware of ADA Requirements'. 3. Establish a grievance procedure January 26, 1992 Ordinance 92 -48, ADA Grievance Procedure and Compliance Committee, adopted July 28, 1992. Committee Members appointed April 13, 1993. 4. Develop a transition plan January 26, 1992 To be complete in August 1995 5. Conduct a self evaluation January 26, 1993 Phase I: Review of County Facilities by Sound Access August 10, 1993. Phase II: Comprehensive review of services, policies and practices including communications and employment to be complete in August 1995. 6. Complete required structural January 26, 1995 Changes have been ongoing in changes facilities as remodels have been completed, and according to capital plans, but are not complete. Whatcom County ADA Plan Due to courthouse construction activity and departmental reorganization, Whatcom County missed the ADA deadlines to complete the transition plan; the self evaluation, and the required structural changes. This plan constitutes the required transition and self evaluation plans, and proposes structural changes to take place over a 5 -year period, from 1995 through 1999.. II. TRANSITION PLAN A. ADA REQUIREMENTS ADA TITLE fl, SECTION 35.150 (d) TRANSITION PLAN (1) In the event that structural changes to facilities will be undertaken to achieve program accessibility, a public entity that employs 50 or more persons shall develop, within six months of January 26, 1992, a transition plan setting forth the steps necessary to complete such changes. A public entity shall provide an opportunity to interested persons; including individuals with disabilities or organizations representing individuals with disabilities, to participate in the development of the transition plan by submitting comments. A copy of the transition plan shall be made available for public inspection. On June 19, 1995 the Whatcom County ADA Compliance Committee, which includes five individuals with disabilities, reviewed this plan and recommended that the County adopt it. Interested persons may obtain a copy. of this plan from the office of ADS /Purchasing, basement, Whatcom County Courthouse, 311 Grand Avenue, Bellingham WA 98225. Telephone (360) 676 -6733. TDD 738 -4555. This plan may be made available on request in alternative formats. Interested persons are invited to participate by submitting comments in written or recorded form to Nat Dickinson, ADA Coordinator, ADS /Purchasing, or by attending a public hearing on the plan. The hearing is tentatively scheduled to be held by the Whatcom County Council at 7:00 p.m. August 1, 1995 in the Council Chambers, first floor County Courthouse. After adoption, the plan will be submitted to the Whatcom County Executive for consideration in development of the 1996 Whatcom County government budget. (2) If a public entity has responsibility or authority over streets, roads, or walkways, its transition plan shall include a schedule for providing curb ramps or other sloped areas where pedestrian walks cross curbs, giving priority to walkways serving entities covered by the Act, including State and local government offices and facilities, transportation, places of public accommodation, and employers, followed by walkways serving other areas. (3) The plan shall, at a minimum -- (i) Identify physical obstacles in the accessibility of its programs or activities 2 public entity's facilities that limit the to individuals with disabilities; Whatcom County ADA Plan (ii) Describe in detail the methods that will be used to make the facilities accessible; (iii) Specify the schedule for taking the steps necessary to achieve compliance with this section and, if the time period of the transition plan is longer than one year, identify steps that will be taken during each year of the transition period; and (iv) Indicate the official responsible for implementation of the plan. The Whatcom County transition plan identifies physical barriers to program access, methods proposed to remove the barriers, and a proposed schedule for removal. The Whatcom County Executive is responsible for implementation of the plan. (4) If a public entity has already complied with the transition plan requirement of a Federal agency regulation implementing Section 504 of the Rehabilitation Act of 1973, then the requirements of this paragraph (d) shall apply only to those policies and practices that were not included in the previous transition plan. ; Whatcom County did complete a transition plan as required under section 51.55(c) of the Discrimination on the Basis of Handicap Regulations 31 CFR Part 51, which was required of agencies that were receiving federal funds. The report is titled Whatcom County Washington Transition Plan, October 17, 1984, in Compliance with the United States Department of the Treasury, Office of Revenue Sharing, Discrimination on the Basis of Handicap Regulations. It Whatcom County ADA Plan C. EXCEPTIONS ADA TITLE II, SECTION 35.150 EXISTING FACILITIES (a) General. A public entity shall operate each service, program, or activity so that the service, program, or activity, when viewed in its entirety, is readily accessible to and usable by individuals with disabilities., This paragraph does not.- (1) Necessarily require a public entity to make each of its existing facilities accessible to and usable by individuals with disabilities; (2) Require a public entity to take any action that would threaten or destroy the historic significance of an historic property, or (3) Require a public entity to take any action that would result in a fundamental alteration in the nature of a service, program, or activity or would result in undue financial and administrative burdens. There are four facilities, five courtrooms and a ferry which would require major structural.;. changes to remove barriers to access, but which Whatcom County has decided not to make completely accessible. 1. 5256 Northwest Road is a one -story former residence located next to the Northwest Annex office building. It does not have accessible parking, entrance, or restrooms. It is being used by the Public Works Department for occasional training of employees. The value of the building does not justify spending significant. funds on improvements. There will be no public access to this _facility. If an employee with a disability requires access to any activity offered in this facility, but cannot gain access, the activity will be moved to an accessible location. 2. The basement of 316 Lottie Street is temporarily occupied by two solid waste employees of the Public Works Department. The basement does not have accessible restrooms. The County plans to make the street level floor of the building accessible. However, the basement of the building is primarily used for storage. The value of the space for office use does not justify spending significant funds to install restrooms. The solid waste function is administered out of the Public Works office, first floor County Courthouse. Access to these two employees, and to any information regarding county solid waste programs, may be accessed in that location. 3. The Roeder Home is on the National Historic Register. The Parks Department plans to make the first floor of the house as accessible as possible by providing parking and a platform lift into the building from the carriage entrance, and by making the first floor restroom usable by a wheelchair user. However, in making these changes, extreme care will be taken not to threaten the historic significance of the building. Therefore the basement and upper floors will not be made 6y Whatcom County ADA Plan accessible. Samples of items on display in the upper floor will be made available on the first floor for persons who are not able to climb the stairs. Crafts classes offered in the basement may be moved to an accessible location in the Bellingham .Senior Center if access by a person with a disability is required. 4. Hovander Homestead House is on the National Historic Register. Hovander Homestead Park will be made accessible with the exception =of the Hovander House. The historic nature of the building would be irreparably damaged by structural changes that. would be required to provide accessibility. Descriptive materials, including a. video tape of the interior and furnishings, will be made available for persons with disabilities who are not able to enter the building. 5. Of the nine 'courtrooms in the Whatcom County Courthouse, three Superior Court courtrooms (Numbers 1 and 3 on the third floor, and Number 2 on the second floor) and the two older District Court courtrooms on the fourth floor would require remodeling to be made accessible which would be so extensive as to be cost prohibitive at this time. According to N.F. Jackson, Superior Court Clerk and designated ADA representative for the courts, accessibility to courtroom proceedings will be provided by the Clerk's office. The fifth floor Superior Court Commissioner's courtroom is entirely accessible but for the judge's bench itself. Accessible jury deliberation suites are available on the second and third floors. The two newer District Court courtrooms on the fourth floor are also accessible in all respects except for the judge's bench and the jury box. If a proceeding, either Superior, District, or Juvenile Court, is scheduled that requires a juror in a wheelchair, the first priority will be to schedule the proceeding in the fifth floor Superior Court Commissioner's courtroom. 6. The ferry 'Whatcom Chief' approximately 100 feet long, 45 feet wide, and 78 tons in weight. It carries approximately 20 automobiles when fully loaded. It operates year round between Gooseberry Point and Lummi Island, a 15- minute ride. It is operated by the Whatcom County Public Works Department, Equipment Rental Division. The ferry has no toilet facilities. Two portable toilets are provided at each terminal. Public Works will provide one accessible portable toilet at each terminal. The inside passenger area on the ferry is not accessible to wheelchair users. There is a 6 -inch perpendicular rise from the car deck to the passenger area door. The door is 26 inches wide. To install a ramp and a 32- inch -wide door would require a major reconfiguration of the car deck and the cabin structure to comply with ADA accessibility guidelines. Most of the passengers who travel on the ferry make the trip in an automobile. Very few enter and use the inside passenger area. All wheelchair users who travel regularly on the ferry at this time travel in automobiles. R Whatcom County ADA Plan The Department of Justice has not yet issued ADA guidelines specific to public ferries. At this time the County does not plan to modify the `Whatcom Chief' to accommodate wheelchair users in the inside passenger area. When the County replaces the vessel, it will replace it with one that is accessible. D. WHATCOM COUNTY FACILITIES Two facilities were inspected and found not to need structural changes to remove barriers to access. They are the Northwest Annex at 5280 Northwest Drive, and the County Health Department at 1500 North State Street, both in Bellingham. Facilities found to need structural changes and included in this section are as follows: 1. Whatcom County Courthouse 2. Forest Street Annex 3. The Point Roberts Community Center is owned by the Point Roberts Park District. Whatcom County ADA Plan III. SELF EVALUATION PLAN A. ADA REQUIREMENTS ADA TITLE II, SECTION 35.105 SELF EVALUATION (a) A public entity shall, within one year of the effective date of this part, evaluate its current services, policies, and practices, and the effects thereof, that do not or may not meet the requirements of this part and, to the extent modification of any such services, policies, and practices is required, the public entity shall proceed to make the necessary modifications. Due to courthouse construction activity and departmental reorganization, Whatcom County missed the January 26, 1993 ADA deadline to complete a self evaluation. The first phase of the Whatcom County government ADA self evaluation began with a review of County facilities by an ADA contractor, Sound Access, in June and July 1993. The evaluation was published in two volumes on August 10, 1993, Americans with Disabilities Act of 1990 Compliance. Review of Whatcom County. The second phase of the self evaluation began in December 1994, coordinated by the county ADA coordinator. Each County department and division appointed an ADA liaison to work with the ADA coordinator to find existing barriers to accessibility in programs, and to remove them. ADA liaisons met for training on December 9, 1994. The session was keynoted by Shirley Van Zanten, County Executive. Training was provided by Carol Maher, a county resident, a member of the Governor's Committee on Disability Issues and Employment, a member of the Whatcom County ADA Compliance Committee, and herself a person with a disability. Departmental ADA liaisons took comprehensive self evaluation forms back to their areas and filled them out, or wrote narratives after reviewing the items on the forms. On January 12, 1995 the liaisons met again for training and discussion of their draft evaluation. Completed forms or narrative were collected by the ADA coordinator and used to develop the self transition and self evaluation plans. After reviewing the physical barriers reported by department liaisons, the ADA coordinator began the survey of all county facilities, and developed the transition plan. Participating were facilities management staff, parks and senior services staff, department liaisons, and Carol Maher. (b) A public entity shall provide an opportunity to interested persons, including individuals with disabilities or organizations representing individuals with disabilities, to participate in the self evaluation process by submitting comments. The ADA Compliance Committee held a public hearing on November 28, 1994 to consider a complaint filed by Community Action for the Disabled, an organization 44 Whatcom County ADA Plan representing individuals with disabilities. The County ADA coordinator described the self evaluation plan. Testimony and discussion at the hearing focussed on barriers to access in Whatcom County government facilities and programs. Some of the persons with disabilities, or representatives of persons with disabilities, who spoke at the hearing were Kurt Dessauer, Tony Donato, Tony Vanderpol, Josselyn Winslow, Rodney Lund, Dr. Fred Rose, and Dick Hayes. When the ADA coordinator was preparing to purchase assistive listening devices for the County Council Chambers and the courts, Glen Bocock and Dr. Fred Rose, persons with hearing disabilities, assisted by testing the proposed devices. On June 19, 1995 the Whatcom County ADA Compliance Committee recommended that the County adopt this ADA transition and self evaluation plan. The plan is being made available to the public for review and comment during the month of July 1995. The Whatcom County Council is tentatively scheduled to hold a public hearing to solicit public comment and to adopt the plan on August 1, 1995. (c) A public entity that employs 50 or more persons shall, for at least three years following completion of the self evaluation, maintain on file and make available for public inspection: (1) A list of the interested persons consulted, (2) A description of areas examined and any problems identified, and (3) A description of any modifications made. The County ADA coordinator maintains this information on file in the Whatcom County Administrative Services Department. (d) If a public entity has already complied with the self evaluation requirement of a regulation implementing section 504 of the Rehabilitation Act of 1973, then the requirements of this section shall apply only to those policies and practices that were not included in the previous self evaluation. Whatcom County did complete a self evaluation as required of agencies receiving federal funds under section 51.55(c) of the Discrimination on the Basis of Handicap Regulations 31 CFR Part 51. The report is titled Whatcom County .Washington Transition Plan, October 17, 1984, in Compliance with the United States Department of the Treasury,. Office of Revenue Sharing, Discrimination on the Basis of Handicap Regulations.. The report has been reviewed as part of this self evaluation process. 45 Whatcom County ADA Plan B. ADA COMPLIANCE COMMITTEE As part of the grievance procedure as required by ADA Title II Section 35.107, Whatcom County adopted Ordinance 92 -48, establishing the ADA Compliance Committee. The committee consists of two elected officials, three members of the disabled cornmunity, and two members of the general public. The committee was appointed in April 1993, all five members of the public being persons with disabilities. Elected officials are Michael Moynihan, Superior Court Judge, and Barbara Cory, Treasurer. Members of the disabled community are Glen Bocock, Josephine Davidson, and JoAnn Mancinelli. Members of the public are Bill Dittrich and Carol Maher. Chair is Josephine Davidson. The duty of the committee established by the ordinance is to hear appeals to decisions by the ADA coordinator regarding ADA complaints. However, during the course of the development of the self evaluation plan, the committee has also functioned in an advisory capacity to the County on ADA matters. Committee members attended the January 12 training session for ADA department liaisons, discussed draft evaluations, and led small groups in identifying barriers to access in the courthouse. The committee reviewed this self evaluation and transition plan in draft form before it was submitted to the public ;for comment. The committee attended the public hearing held by the County Council and helped present the plans to the Council and to the public. On May 10, 1995 the committee recommended to the County Executive that the County broaden the scope of the committee's role to act as an advisory council to the Executive, and that the ADA coordinator work with the committee to determine the priority of ADA projects and submit them to the Executive for budgetary consideration. The County's ADA transition plan proposes structural changes to be carried out each year from 1995 through 1999. RECOMMENDATION: Broaden the scope of the committee's role to act as an advisory council to the Whatcom County Executive. 2. Establish a policy that the ADA coordinator work with the department ADA liaisons and with -the ADA committee each year from 1995. through 1999 to determine the priority of ADA projects and submit them to the Executive for budgetary consideration. 3. EFFECTIVE COMMUNICATIONS Virtually all departments identified effective communications with persons with disabilities as a significant problem. Facility signage to access was an example. Locations of signs required were identified, and the process of procuring and mounting signs was begun. Numerous signs were provided for features in the County Courthouse. An article was published in the local newspaper. Also noted was the need for effective communications with County employees. An article was published in the County newsletter. At least one ADA training session should be offered to County employees every year. New employees especially should be encouraged to attend. Training in effective communications with individuals with disabilities for County employees is planned for Fall 1995. Information sheets will be distributed for posting in departments to ensure that communications with persons with disabilities are as effective as communications with others. For example, to communicate with the deaf, hard of hearing, or,speech impaired, AT &T provides an operator relay phone call service that is' efficient, friendly, and easy to use. There is a TDD typing telephone at the information. desk at the courthouse rotunda, and a TDD pay phone in the phone bank on the first floor of the courthouse. There is a TDD on the main floor of the Forest Straet Annex. County employees need experience trying out the AT &T and TDD service so that they will be able to use them when they are needed. Assistive listening devices are available in the Council Chambers and in the courtrooms. A portable system can be provided for meetings if needed. There is a service in town that will provide closed captioning for meetings, so that everything that is said appears immediately on a large screen for everyone to see, and is preserved on a computer diskette. For the sight impaired, most copy machines and computers can convert information to large type. Many persons with visual impairments can use computer diskettes at home to convert information to a usable form. There is a service in town that will convert printed information to Braille form. County employees can read aloud directly to an individual, or into an audio tape recorder. Information is to be provided on request. Primary consideration will be given to the request of the individual needing the auxiliary aid or service. Focus will be on the specific information needed, and the specific format or service that the individual requests as most useful. 3. ' ACCESSIBLE MEETINGS ADA Title II Section 35.150 requires that `A public entity shall operate each service, program, or activity, so that the service, program, or activity, when viewed in its entirety, is readily available to and usable by persons with disabilities'. This obligates county government to hold all public meetings in facilities that are accessible. There have been numerous public meetings this year scheduled inadvertently in facilities :1 R11 I I L Whatcom County ADA Plan that are not accessible. For the most part they have been moved to accessible locations when at all possible before the meeting took place. Nonetheless, county departments and agencies need better information about how to ensure a meeting place is accessible before scheduling a meeting, and how to make sure that members of the public have the opportunity to request special needs. RECOMMENDATION: a. Each department should be encouraged to identify the individuals who are responsible to schedule public meetings, and that each be provided with the checklist from Accessible Meetings in Washington State Planning and Resource Guide published by the Governor's Committee on Disability Issues and Employment. b. The ADA coordinator should maintain a list of known accessible meeting sites, and make it available to departments annually. C. The ADA coordinator should maintain a list of resources such as assistive listening devices and and interpreting services that can be made available. d. Before scheduling a public meeting in a place not on the list, departments should be encouraged to ensure that the facility is accessible. Before being scheduled, the meeting place should be personally inspected, and an ADA Accessible Meetings Checklist should be filled out. When distributing notice of the meeting, departments should include a statement that informs members of the public how to request special needs: People with special needs or disabilities who will be attending this meeting are asked to please contact our office (Include telephone number, and contact name if necessary) at least 48 hours in advance, so that we may make any needed accommodations. If interpretive services or transportation is needed, please call more than two days ahead of time. e. Individuals responsible for scheduling public meetings be encouraged to request informational materials and become familiar with the times and places served by the Whatcom Transportation Authority specialized transportation program for persons with disabilities. 4. CONTRACTING FOR SERVICES ADA Title II Section 35.150 requires that 'A public entity shall operate each service, 50 Whatcom County ADA Plan program, or activity, so that the service, program, or activity, when viewed in its entirety, is readily available to and usable by persons with disabilities'. This obligates county government to ensure that contractors providing services, programs, or activities for the County comply with the provisions of the act. The ADA states that a public entity may not directly or through contracts discriminate against persons with disabilities in providing aid, benefits, services or employment. An agency that enters into contracts with other agencies to provide services must ensure that those agencies are not violating the ADA. To ensure compliance, the persons involved in negotiating, writing, approving, managing, and auditing contracts need to be aware of the requirements of the ADA. The following language is recommended by the Whatcom County Prosecuting Attorney's office, and is normally included in contracts for services: Non - Discrimination in Employment: The Contractor shall not discriminate against any employee or applicant for employment because of race, color, religion, sex, national origin, creed, marital status, age, Vietnam era veteran, or the presence of any sensory, mental or physical handicap. The contractor shall take affirmative action to insure that applicants are employed and treated during employment, without regard to the above listed criteria. Such action shall include, but not be limited to the following: employment, upgrading, demotions, or transfers, recruitment or recruitment advertising; layoffs, or terminations; rate of pay or other forms of compensation; selection for training including apprenticeship; and participation in recreational and educational activities. The Contractor agrees to post, in conspicuous places available to employees and applicants for employment, notices identical to those used herein setting forth the provisions of this non - discrimination clause. In all solicitations or advertisements for employees placed by them or on their behalf, the Contractor shall state that all qualified applicants will receive consideration for employment without regard to the above listed criteria. They shall cause the foregoing provisions to be inserted in all subcontracts for any work covered by this Contract so that such provisions shall be binding upon each subcontractor; provided, that the foregoing provisions shall not apply to contracts or subcontracts for standard commercial supplies or raw materials. "rhe Contractor, in determining (1) the types of services or other benefits to be provided, or (2) class of individuals to whom or the situation in which such services or benefits,will be provided, or, (3) the class of individuals to be afforded an opportunity to participate in any services or benefits, will not utilize criteria or methods of administration which have the effect, of subjecting individuals to discrimination because of race, color, sex, religion, national origin, creed, marital status, age, Vietnam era veteran or the presence of any sensory, mental or physical handicap or have the effect of defeating or substantially impairing the accomplishments of the objectives of the Contract in respect to the individuals having a particular race, color.,.... sex, religion, national origin, creed, marital status, age, Vietnam era veteran or the presence of any sensory, mental or physical handicap. RECOMMENDATION: a. When Whatcom County contracts with another entity to provide services to individuals, or to provide funding for services to the public, or to design, remodel, or construct a facility, language should be included in the contract to the effect that the contractor is aware of and will perform the services in compliance with the requirements of the ADA and its implementing regulations: -rhe Contractor hereby agrees to comply with the Americans with Disabilities Act of 1990 and with all -the implementing requirements and regulations imposed by the U.S. Equal Employment Opportunity Commission and the U.S. Department of Justice. b. When the County contracts with a social service agency for service to individuals or to provide funding for services to the public, evidence of an ADA self evaluation and an ADA transition plan should be required. C. When the County conducts a performance review or a program audit of any contract with another entity to provide services to individuals or to provide funding for services to the public, the County should evaluate the entity's compliance with the ADA. d. When the County considers acquiring or leasing a facility, it should evaluate the facility's compliance with ADA guidelines. 52 I 1 Whatcom County ADA Plan E. EMPLOYMENT AND HIRING by Betsy Barney, Human Resources Analyst The Human Resources section of -the Administrative Services Department is responsible for general administration of the Whatcom County employment and hiring program. The program is implemented, jointly by County departments and Human Resources. Title I of the ADA requires that individuals with disabilities be given the same consideration for employment that individuals without disabilities are given. A qualified individual with a disability is one who satisfies the requisite skill, experience, education and other job - related requirements of the employment position and can perform the essential (as distinguished from "marginal ") functions of the job with or without accommodation. Whatcom County conducts an employment program designed to comply with the ADA.; Responsibility for various aspects of the program is shared by the Human Resources Division of Administrative Services and each department of Whatcom County. Specific areas of the program are described below. 1. Recruitment including job announcement postings, application screening, interviews, new employee orientations all of which bring people into the organization. 2. Ongoing services to employees and administrators include classification, compensation, collective bargaining, computer payroll /personnel record input and review, benefits coordination, grievance arbitration, and maintenance of employer records on employees. JOB DESCRIPTIONS Job descriptions are prepared before advertising or interviewing applicants for the position. They contain the following statement: "It is the policy of Whatcom County to not discriminate against any person with regard to race, color, religion, sex, age , national origin, marital status or physical or mental disability." This part of the job description is in 8 pt. font; the rest is in 12 pt. font. The entire description can be enlarged upon request for easier reading. They also differentiate between Essential Job Duties and Additional Job Duties and contain a paragraph of Working Conditions which explain the physical and sensory requirements or context in which the work of the position is performed. No job description is used as a basis for hiring without updating to contain this information. The task of updating job descriptions has been in progress for the past 4 53 Whatcom County ADA Plan years and is nearing completion. JOB ANNOUNCEMENTS, ADVERTISEMENTS (MEDIA, JOB POSTINGS AND MAILING LISTS) AND EMPLOYMENT APPLICATION Job announcements, summarizing job openings, contain the same statement affirming non - discrimination as the job descriptions. Newspaper advertising states that we are an Equal Opportunity Employer. Short ads just say EOE at the end. All departments within Whatcom County have been given an enlarged posters for lobby areas (attached) which defines our commitment to ADA. At the top of the Employment application in small letters we state 'Whatcom County is an EQUAL OPPORTUNITY EMPLOYER'. Employment applications consist of two kinds, the basic application and the supplemental application which is job- specific. These use clear print and contrasts to make lettering stand out. A statement of County compliance with ADA is on the supplemental- form: Attached to the application is a half sheet containing Affirmative Action Data. It contains. the statement, 'It is the policy of Whatcom County to provide equal opportunity in all terms, conditions and privileges of employment for all qualified job applicants and employees without regard to race, color, national origin...or the presence of any sensory, mental or physical disability. To help us comply with government record keeping, reporting and other legal requirements, please complete the affirmative action data below. Providing this information is voluntary and will be kept in a confidential file separate from the application form...' Affirmative Action Data attachment can be retyped for enlarging. Enlargements of both application and affirmative action data (11 x 17) are available on request. Advertisements are routinely placed in The Bellingham Herald; less frequently in one or more of the following depending upon the job: The Seattle Times; The Spokesman Review (Spokane); The Oregonian; The Everett Herald; other regional newspapers; small Western Washington weekly newspapers; Jobs Available, a listing of jobs in the public sector throughout the western United States. Targeted advertising within an occupational specialty is typically done by individual departments rather than by Human Resources. A telephone job line lists. jobs available on a weekly basis and is printed prominently on the application form. As needed, information can be read aloud to individuals lacking sight, or recorded on tape or given enough lead time, can be provided in a braille translation or in large print copies of materials. The Telephone Relay service provided by the phone company or TDD (available in the Courthouse) or FAX Machine are existing methods for communication with those who have hearing loss in addition to various types of written communication including note writing. 54 I . S t f I 1 Whatcom County ADA Plan Postings of application materials occur at Human Resources and _at County Departments as well as at agencies and organizations on a Mailing List. Applications are contained in clear plastic wall containers over which large print signs have been placed in high contrast colors. A wheelchair accessible table for applicants to use is perpendicular to the wall containing the application materials. Job announcements are found not only at the Human Resources Office but are distributed for posting to other departments in the County. As indicated in the facilities section of these recommendations, the wall containers need to be lowered and lobby entry modifications need to be made to make entry easier for those with disabilities. Besides the application materials, a notice of County compliance with ADA (see attached) is mounted on the wall near other posted materials in Human Resources. The same notice has also been distributed to other departments for posting. A mailing list is used to send a list of job openings to groups and educational institutions that have indicated an interest in this information. Individuals or organizations who assist people with disabilities may request ADS /Human Resources to add their name to the mailing list for purposes of recruitment. RECOMMENDATION: The longer standard EOE statement should be revised to read Whatcom County is an Equal Opportunity Employer committed to diversity in its workforce and to compliance with the .Americans with Disabilities Act of 19901 . 2. The County TDD telephone number should be added to the employment application form. 3. Departments should be encouraged to use local radio public service announcements to advertise for job applicants. 4. Departments should be encouraged to use CIVICNET to advertise for job applicants. 5. The telephone job line should include TDD and FAX numbers, the EOE statement, . and the standard language for communicating with persons with disabilities: `People with special needs or disabilities who will be applying for employment are asked to please contact our office (Include telephone number, and contact name if necessary) at least 48 hours in advance, so that we may make any needed accommodations. If interpretive services or transportation is needed, please call more 55 Whatcom County ADA Plan than two days ahead of time.' EMPLOYMENT AND HIRING PROCEDURES Whatcom County does riot have a Civil Service System. The Human Resources Manager does not report to a Board or Commission charged with administering -the System. There are no public meetings at which it might be expected that accommodations would need to be made, other than the County Council Meetings. However were it necessary, a captioner or signer or some other type of oral communication could be used as accommodation in conducting training, interviews and employee orientation sessions depending upon the needs of -the individuals involved. Relationships with employees are governed by contractual relationships and procedures developed to implement legal requirements. The County approach to reasonable_ accommodation is made on a case -by -case basis, department by department. Written employment procedures have recently been revised (5/95) and training was recently conducted for department heads and key staff on the procedures and on effective interviewing. Both the training and the written guide produced as a followup contain specific instructions on responsibility to provide reasonable accommodation and accessibility. Individual departments each have a staff person assigned to ADA who coordinates with the County ADA Coordinator. Another feature of the Employment program recently updated and revised is the. New Employee Orientation materials, which advise employees about Whatcom County as an organization and employer, cover benefits information and County commitment to ADA. None of these has yet to be prepared in alternative formats, but could be converted to Braille or large print. In -house promotional procedures and external hiring procedures differ. In -house procedures are ruled by provisions of collective bargaining agreements which are uniform for all employees of the bargaining unit. External hiring procedures apply to all applicants equally. They include: ♦ Completion of an application, often including supplementary application material; ♦ Meeting required qualifications listed in the job announcement. These qualifications are determined to be that experience, education, knowledge, skills, abilities and job behaviors necessary to perform the essential functions of the job for which application is being made. ♦ Skills performance testing when the requirements of the position make this appropriate. ♦ Application screening and interview of candidates whose background provides the best match to job requirements. 56 I . I Whatcom County ADA Plan Any of these could potentially have an adverse impact without accommodation. To avoid problems, it is very important that advance notice is given to the County by those who need accommodation so that proper arrangements can be made. Human Resources maintains a separate and confidential file of information provided voluntarily by persons with disabilities about desired accommodations for entry into the employment program. This information is shared only with the ADA Coordinator and is in no way visible or known during application and testing processes except in those cases where the person with -the disability is present and reveals the disability by observable actions or comments. Human Resources has standardized many forms and procedures used in the testing process and develops or reviews application and interview materials prepared by departments to assure the.,appropriateness of materials and to ensure that they contain=.. no information to cause adverse impact against people with disabilities. When skills performance is tested alternative formats can be devised for administration of tests, 'time requirements can be waived if appropriate to -the disability, use of technological assistance can be allowed if appropriate, and other types of aids -- including human - -can be allowed as appropriate to provide accommodations that would work on the job. The area of physical qualifications is most likely to require accommodation through technology or minor adjustments in non - essential duties. Physical requirements have been identified clearly in.job descriptions and job announcements so that a person with disabilities knows job demands and can identify ways for accommodation to occur. Until this year we have had a Human Resources representative on all interview committees. One of her functions was to prevent other committee members from erring in the conduct of interviews. This year as a result of budget cuts, a Human Resources representative will no longer be able to serve on each committee. An instructional program and guide have been developed and implemented to allow departments to monitor interviews. The topic of inappropriate and illegal inquiries and considerations is addressed in . the materials developed by Human Resources. Many examples of appropriate_ questions for interviews have been provided in these materials and each department's intended questions are reviewed by Human Resources prior to use. Human Resources instructions for interviewers clearly state that discrimination is not allowed and stress that candidates should be assessed in terms of what they have done. Employment processes are carried out at a variety of County facilities according to a newly revised and implemented employment procedure. Each department has the responsibility to assure that facilities utilized for employment and other program functions 57 Whatcom County ADA Plan are.accessible to all. Each department has had access to training and information on the implementation of ADA. EMPLOYMENT DECISIONS AND ACTIONS Human Resources provides oversight of County actions relating to hiring, reclassification, promotion, transfer, disciplinary action, layoff, termination, right of re- employment and return from layoff to assure the consistent application of standards and equal consideration of individuals in each type of decision, in compliance with ADA. The requirements and compensation for positions are established in advance of public announcement. Pay rates are established through comparisons with similar jobs and employers and involve union negotiations. No decision is related to disability. Temporary "light duty" placements are sometimes made and some job restructuring has occurred to accommodate employees who are disabled. MEDICAL EXAMINATIONS Pre - employment medical examinations are not typically required. When they are, the requirement is based upon the law or the demanding physical nature of the job. Such exams are done only after a conditional offer of employment is made. There is no intermingling of confidential medical records and other records. Medical records are filed confidentially and separately from other personnel files. DRUG TESTING Drug testing is conducted according to legal requirements. Arrangements are made by individual County departments employing staff who are involved in commercial transportation or security occupations. Results of drug testing are confidential and are kept separately from other personnel records. The impact of prescription drugs on employability would depend upon the job, the law and any feasible accommodations. POST ADMISSION INQUIRIES Once people have become employees, the only inquiries made about disabilities would be for the purpose of fine tuning accommodation plans. The employee would be involved in the decision - making process. BENEFITS Benefits are determined through collective bargaining, County policy and Council F Whatcom County ADA Plan approval. Benefits are in accordance with legal requirements and undergo legal review prior to agreement to assure compliance with applicable federal and state laws. SENSITIVITY TRAINING The separation of ADA oversight from Human Resources management brings into question the responsibility for sensitivity training and how extensive this should be. At present, this too should probably be done on a "case by case" basis. The County provided training in 1994 -95 to employees functioning as departmental ADA liaisons in preparation for this report. Human Resources training on employment procedures and interviewing stressed this area as well. COORDINATION AND CONTRACTUAL RELATIONSHIPS WITH "OUTSIDE" PERSONS AND ORGANIZATIONS Human Resources functions require coordination and contractual relationships with health care providers, departments of the local, state and federal government, such as Labor and Industries, Licensing, Health, and Sheriff; colleges and vocational schools, third party administrators (benefits program), labor negotiators and labor unions, news media, vendors, and the telephone company. The assurance of ADA compliance is one of the factors involved in establishing these relationships.
