The proposed resolution will provide guidance to the Administration in proceeding with dealing with the
problems in Drayton Harbor. RCW 90.72.045 which required the establishment of a Shellfish Protection District
also requires the establishment of a program to address the problems.

2 DRAYTON HARBOR WATERSHED SHELLFISH PROTECTION DISTRICT
3 WATER QUALITY RECOVERY PLAN
4 WHEREAS, in response to the letter from Council. Chair Imhof requesting specific
5 information regarding the conditions necessary to upgrade the status of Drayton Harbor, the
6 Department of Ecology has responded with specific requirements necessary to secure the
7 return of Drayton Harbor to an approved status; and
8 WHEREAS, federal guidelines require that water quality, shoreline contamination
9 sources, and hydrographic analysis of Drayton Harbor be found acceptable in order to justify
10 an upgrade in status; and
11 WHEREAS, RCW 90.72.03 states that "program(s) shall include any elements
12 deemed appropriate to deal with the non -point pollution threatening water quality...'; and
13 WHEREAS, the memorandum titled Drayton Harbor Shellfish Protection District
14 Program Analysis from Planning and Development Services dated June 26, 1995 confirms
15 that "Considerable work has been done in the Initial Closure Response Strategy and the
16 Drayton Harbor Watershed Management Plan';
17 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the
18 following goals and objectives shall be included in the plan to address the problems within
19 the Drayton Harbor watershed:
20 1) Prevention of any further degradation and contamination of Drayton Harbor.
21 2) Implementing actions which will lead to a removal of the State Department of Health
22 shellfish downgrade of Drayton Harbor.
23 3) Coordinating County actions with those of other state and local agencies.
24 4) Designing and implementing a County program which addresses these areas identified
25 as "high priority" for the County in the Drayton Harbor Shellfish District Program Analysis:
