The road proposed to be vacated is described as follows: "A portion of Park Lane as platted in Birch Bay
Park First Addition, recorded in Volume 6, Page 18 of Plats, Section 31, Township 40 North, Range 1 East
of W.M., Whatcom County, WA. Said portion further described as the full width of Park Lane abutting the
northeasterly 20 feet of Lot 1, Block 16 and the southeasterly 20 feet of Lot 6, Block 15 of said Birtch Bay
Park First Addition. Containing. approximately 400 square feet. ". The petitioner offers the following
pertinent facts in support of the petition: "The slope of the road is too steep for road construction. The
area is needed for parking."

2 VACATING A PORTION OF PARK LANE
3 WHEREAS, a petition to vacate a portion of Park Lane, as platted in Birch Bay Park
4 First Addition has been received from Genda Haynes and Mark Beckwith, et al, and
5 . WHEREAS, on April 20, 1995, Genda Haynes and Mark Beckwith, et al, submitted a
6 petition, accompanied by the penal sum of $682.00, to Public Works Engineering for the
7 vacation of the portion of Park Lane described as: The full width of Park Lane abutting the
8 southeasterly 20 -feet of Lot 1, Blk. 16 and the southeasterly 20 -feet of Lot 6, Blk. 15 of Birch
9 Bay Park First Addition, Recorded in Volume 6, Page 18 of Plats, Section 31, Township 40
10 N., Range 1 East of W.M., and
11 WHEREAS, The petitioners submitted pertinent facts stating that the road is too steep
12 to be developed into a public roadway and therefore is useless for part of the County road
13 system, and,
14 WHEREAS, the County Engineer's office has reviewed the above named portion of the
15 roadway, determined a fair market value of $972.00 for said portion and concurs with the
16 petitioner that this is useless for the County road system and the public would benefit from
7 the vacation, and
18 WHEREAS, the County Engineer recommends approval of this vacation subject to the
19 payment of $972.00 within six months of Council action.
20 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the
21 above described portion of Park Lane as petitioned for by Genda Haynes and Mark Beckwith,
22 et al be hereby Vacated.
