Planning and Development Services received five transfer applications for Open Space /Timber from Karl
ncmz Schwab, Lynne Chamberlain, Tom Craft, the Kelly McClurg Living Trust, and James & Colleen Griggs, and
four new applications for Open Space Timber from Tom Westergreen, Great Western Lumber Company, Robert
Satushek, and James & Colleen Griggs. All applications were reviewed by Planning Division staff using criteria set
forth in Chapter 84.34.041 RCW. The attached Staff Report contains maps, aerial photos, and summary information
on each application.
ORIGINATOR'S RECOMMENDED ACTION:
The Director of Planning and Development Services recommends the Council uphold the Planning Division
recommendations and approve the above nine Open Space /Timber applications for Open Space tax status by adopting
the attached resolution.

A RESOLUTION ADOPTING RECOWAIENDATIONS FOR 1995 =A OPEN
SPACEITIMER APPLICATIONS
WHEREAS, the Planning Division received nine (9) applications for open space land tax
assessment for review and recommendations pursuant to RCW 84.34; and
WHEREAS, pursuant to WAC Section 197- 11- 800(6)(c), matters relating to Open Space
taxation are determined not to be major actions and are exempt from the threshold determination and
environmental impact statement requirements of the State Environmental Policy Act; and
WHEREAS, pursuant to RCW 84.34.041, applications for Open Space /Timber are not subject
to evaluation under the County's Public Benefit Rating System but must meet certain criteria
established in RCW 84.34.041; and
WHEREAS, pursuant to RCW 84.34.041, recommendations for approval or denial of Open
Space /Timber applications are made directly to the Council from the ,Planning Division and are not
subject to Planning Commission review; and
WHEREAS, the Planning Division reviewed the five applications for transfer from
Classified /Designated Forest from Karl Heinz Schwab, Lynne Chamberlain, Tom Craft, the Kelly
McClurg Living Trust, and James & Colleen Griggs, and four new applications from Tom
Westergreen, Great Western Lumber Company, Robert Satushek, and James & Colleen Griggs, and
determined that all met the criteria set forth in RCW 84.34.041; and
WHEREAS, the Planning Division forwarded its recommendations to Council; and
WHEREAS, Council held a public hearing on March 14, 1995 to consider the Planning
Division's recommendations; and
WHEREAS, Council agreed that the nine applications met all the criteria as set forth in RCW
84.34.041.
NOW THEREFORE BE IT RESOLVED BY THE WHATCOM COUNTY COUNCIL:
1. The Whatcom County Council approves the transfer applications to Open Space /Timber from:
Karl Heinz Schwab, Lynne Chamberlain, Tom Craft, the Kelly McClurg Living Trust, and
James & Colleen Griggs; and the new applications to Open Space Timber from: Tom
Westergreen, Great Western Lumber Company, and Robert Satushek, and James & Colleen
Griggs.

2. The Council directs the Assessor to place these parcels in the Open Space /Timber tax status
category.
3. Adjudication of invalidity of any of the sections, clauses or provisions of this Resolution shall
not affect or impair the validity of the Resolution as a whole or any part thereof other than the
part so declared to be invalid.

This report summarizes the Planning Division's recommendations on recently received OPEN
SPACE /TIMBER applications. The Open Space Taxation Act (RCW 84.34) was enacted in 1970
for two primary reasons: to create a tax climate that was equitable to the open space landowner
and to decrease the rate at which open space lands were being converted to non -rural uses.
These were accomplished by providing property tax relief to land that qualifies under one of the
four open space classifications: OPEN SPACE AGRICULTURE, OPEN SPACE /OPEN SPACE, OPEN
SPACE FARM AND AGRICULTURE CONSERVATION, and OPEN SPACE /TIMBER. The Agriculture
designation is administered by the County Assessor while the Open Space, Timber, and Farm &
Agriculture Conservation applications fall under the authority of the County Council. In 1993,
Chapter 84.34 RCW was amended in such a way that applications for Timber are no longer
subject to evaluation under the County's Public Benefit Rating System or review by the Planning
Commission. Whereas Open Space and Farm & Agriculture Conservation are handled in -the same
manner as an amendment to the Comprehensive Plan with review under the County's Public
Benefit Rating System, Timber applications need only to meet the criteria set forth in 84.34.041.
The Council decides on whether to grant the applicant assessment at current use after receiving
a recommendation from the Planning Commission for Open Space and Open Space Farm &
Agriculture Conservation applications, and a recommendation from the Planning Division for Open
Space /Timber applications.
The recommendations for the nine Open Timber applications received are based upon the
application's conformance to criteria set forth in 84.34.041 RCW. All applications are currently
in Designated /Classified Forest or Open Space Agricultural classifications and requesting to
transfer to Timber. Staff evaluations and recommendations with maps and aerials showing
location of each individual application are attached. Also attached is an overall map and Exhibit
1, Chapter 84.34 RCW.
