COUNCIL ACTION TAKEN. 2/28/95: Introduced 3/14/95: Approved 7 -0 Related File Numbers: Ordinance or Resolution Number (this item only): Res. 95 -026 SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE: 2/28/95 RESOLUTION NO. 95-026 2 TO SELL PROPERTY ACQUIRED BY COUNTY 3 ON TAX FORECLOSURE 4 REQUEST NO. 95 -4 5 WHEREAS, R.C.W. 84.64.270 allows the County to sell real estate acquired by tax 6 foreclosure where it is found to be in the best interest of Whatcom County to sell the same; and, 7 WHEREAS, R.C.W. 84.64.320 allows for Tax Title property to be disposed of without bids 8 when the County legislative authority determines that it is not practical to build on the property due 9 to the physical characteristics of the property or legal restrictions on construction activities on the 10 property; and, 11 WHEREAS, the Whatcom County Property Management Committee has recommended the 12 sale of the subject property for the negotiated price; and, WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as negotiator in such sales; and, 15 WHEREAS, the Whatcom County Treasurer has negotiated a sales price of $1.00; and, 16 WHEREAS, R.C.W. 84.64 requires the Council to establish the minimum price for said unit 17 of property and to determine whether or not a contract will be allowed, or if it will be a cash price; 18 and, . 19 WHEREAS, the Whatcom County Code as well as the state law allows the County to reserve 20 from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the Council finds 21 that it is in the best interest to reserve these; 22 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it is not 23 practical to build on parcel 400106- 070334 -0000, having legal description of. ROSBRUGH'S FIRST 24 ADD TO BLAINE LOT 8 BLK 1 - EXC S 25 FT THEREOF, and it is in the best interest of the 25 County to sell said parcel for the negotiated price of $1.00; and, 26 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and shall 27 be paid in either cash, certified check, or money order to the Whatcom County Treasurer at the time 28 of sale; and, Page 1 29 BE IT FURTHER RESOLVED that this sale transfer to the owners all coal, oil, gas, gravel, 30 minerals, ores, fossils, timber or other resources on or in said land and the right to mine for and 1,1 remove the same in conformity with zoning regulations in force and effect; and, 32 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to sell 33 such property at not less than a certified price and said sale shall take place in accordance with the 34 duties as established in R.C.W. 84.64.270. 35 APPROVED this 14 day of March , 1995. 36 37 ATTEST: 39 —'Ram • .� 9. 40 APPROVED AS TO FORM: 41 ,2 Civil Deputy Prosecuting Attorney WHATCOM COUNTY COUNCIL WHATCOM COUNTY, WASHINGTON rRob4A.
