COUNCIL ACTION TAKEN: 2/14/95: Hearing scheduled for 3/7/95 3/7/96: Approved 7 -0 Related File Numbers: Ordinance or Resolution Number (this item only): Res. 95 -02 SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE: 2/14/95 RESOLUTION NO. 95 -023 2 TO SELL PROPERTY ACQUIRED BY COUNTY 3 ON TAX FORECLOSURE 4 REQUEST NO. 95 -2 5 WHEREAS, R.C.W. 84.64.270 allows the County to sell real estate acquired by tax 6 foreclosure where it is found to be in the best interest of Whatcom County to sell the same; and, 7 WHEREAS, R.C.W. 84.64.320 allows for Tax Title property to be disposed of without bids 8 when the sale is to any governmental agency and for public purposes; and, 9 WHEREAS, the Whatcom County Property Management Committee has recommended the 10 sale of the subject property to the City of Everson, Washington, at no less than the sum of taxes 11 owing plus any additional costs and liens at the time of foreclosure; and, 12 WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as negotiator in 13 such sales; and, 14 WHEREAS, the Whatcom County Treasurer has negotiated a sales price of $3,900.96; and 15 WHEREAS, R.C.W. 84.64 requires the Council to establish the minimum price for said unit 16 of property and to determine whether or not a contract will be allowed, or if it will be a cash price; 17 and, 18 WHEREAS, the Whatcom County Code as well as the state law allows the County to reserve 19 from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or other resources if the Council finds 20 that it is in the best interest to reserve these, 21 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it is in the 22 best interest of the County to sell parcel #400431- 204542 having legal description of: BEAP 480 FT 23 W -144 FT S OF QR COR BTWN SECS 30 -31 -TH E 150 FT -TH S 55 FT -TH W 150 FT -TH N 55 24 FT TO POB, to the City of Everson, Washington, for the negotiated price of $3,900.96; and, 25 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and shall 26 be paid in either cash, certified check, or money order to the Whatcom County Treasurer at the time 27 of sale; and, Page 1 28 BE IT FURTHER RESOLVED that this sale transfer to the owners all coal, oil, gas, gravel, 29 minerals, ores, fossils, timber or other resources on or in said land and the right to mine for and 10 remove the same in conformity with zoning regulations in force and effect; and, 31 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to sell 32 such property at not less than a certified price and said sale shall take place in accordance with the 33 duties as established in R.C.W. 84.64.270. 34 APPROVED this 7th day of March , 1995 35 WHATCOM COUNTY COUNCIL 36 ATTEST: WHATCOM COUNTY, WASHINGTON 3 7 r' i ; 38 --Rare-- a Reeves, ounce lerk Robert A.
