1 RESOLUTION NO. 95 -012
2 POLICY ON TRANSFER OF FEE -TITLE LANDS TO
3 FEDERAL TRIBAL TRUST STATUS
4 WHEREAS, over the years, tribal trust lands were sold and transferred into private
5 ownership through fee -title conversions; and
6 WHEREAS, these lands after transfer are included in property subject to taxation
7 and jurisdiction of governmental agencies such as the county, school districts, and fire
8 districts; and
9 WHEREAS, these governmental agencies have developed zoning policies, land use
10 regulations, and other various public services and regulations which assumed and relied
11 upon the inclusion of these former tribal trust lands as integral components of their
12 operations and as payers of a proportionate share of revenue to support governmental
13 operations; and
14 WHEREAS, conversion of these privately owned lands back to tribal trust status
15 intensifies jurisdictional problems related to zoning, land use regulation, water rights, private
16 owners associations, education, and law enforcement; and
17 WHEREAS, it is in the best interests of all affected parties to stabilize jurisdictional
18 boundaries and to minimize the potential for conflict;
19 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that re-
20 conversion of fee -title lands to tribal trust status is found not to be in the best interests of
21 the people of Whatcom County, and the Administration is requested to advise appropriate
22 Federal and Tribal officials that Whatcom county opposes any further transfer of fee -title
23 lands to tribal trust status.
