ORIGINATOR'S RECOMMENDED ACTION. Recommend the Council approve the resolution and set the hearing. COMMITTEE ACTION TAKEN: COUNCIL ACTION TAKEN. 2/14/95: Approved Related File Numbers: Ordinance or Resolution Number (this item only): 95 -011 SPONSORED BYConsent PROPOSED BY: Treasurer INTRODUCTION DATE: 2/14/95 I RESOLUTION NO. 95 -011 2 HEARING AND NOTICE OF HEARING ON 3 SALE OF COUNTY TAX TITLE PROPERTY 4 REQUEST NO. 95 -3 5 WHEREAS, the following described property is now, and has been the property of the 6 County of Whatcom, State of Washington since December 27, 1983; and, 7 WHEREAS, the Whatcom County Council does deem it in the best interest of the County and 8 the people thereof that said property be sold; and, 9 WHEREAS, the Whatcom County Property Management Committee has recommended the 10 sale of the subject property, without bids, at no less than the sum of taxes owing plus any additional 1 l costs and liens at the time of foreclosure, or the negotiated price, whichever is greater; and, 12 WHEREAS, the sum of taxes owing plus any additional costs and liens at the time of 13 foreclosure is $2,213.77; and, 14 WHEREAS, R.C.W. 84.64.320 allows for Tax Title property to be disposed of without bids 15 when the County legislative authority determines that it is not practical to build on the property due 16 to the physical characteristics of the property or legal restrictions on construction activities on the 17 property; and, 18 WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as negotiator in 19 such sales; and, 20 WHEREAS, the Whatcom County Treasurer has negotiated a sales price of $6,000.00; 21 NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that it is not 22 practical to build on parcel 9380108 - 532004, having legal description of: BOLSTERS SANDY PT 23 TRACTS #2- LOT: 106 THRU 112 -EXC N 144 FT THEREOF, and it is in the best interest of the 24 County to sell said parcel for the negotiated price of $6,000.00, and further in this sale transferring 25 all mineral rights; and, 26 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and shall 27 be paid in either cash, certified check, or money order to the Whatcom County Treasurer at the time 28 of sale; and, Page 1 29 BE IT FURTHER RESOLVED by the Whatcom County Council, that a public hearing on 30 the matter of the sale of said property, under said terms, be held on the 7th day of March , 1 1995, at 7 p.m., at the County Council Chambers , Whatcom County, Washington; and, 32 BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council shall give 33 Notice of such hearing in the manner prescribed by law under R.C.W. 36.34.030. 34 APPROVED this 14011ay of February 35 36 ATTEST: 37 38 39 40 41 Ramona Reeves, Council Clerk APPROVED AS TO FORM: Civil Deputy Prosecuting Attorney 1995.
