The ordinance would change the current code to require that an Administrative Director be appointed to
oversee the operations of the Health Department. Currently, the code requires the Health Officer to also
perform these functions above and beyond the professional medical requirements of the Health Officer position.

2 AMENDING TITLE 24 TO REVIEW REQUIREMENTS REGARDING THE
3 POSITION OF ADMINISTRATIVE DIRECTOR OF THE HEALTH DEPARTMENT
4 WHEREAS, the County Code requires that the Health Officer serve as head of
5 the Health department; and
6 WHEREAS, state law does not carry such a requirement, and it is hereby found
7 to be advantageous to expand the option of separating the professional duties of the
8 Health Office from the administrative duties of a Director of the Health Department;
9 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that
10 Title 24 of the Whatcom County Code, Chapter 24.01 is amended as follows:
11 24.01.030 Administration is deleted in its entirety and replaced with:
12 24.01.030 Administrative Director. Health Officer Appointments
'3 A. Administrative Director. In accordance with R.C.W. 70.05.040 the County
A Executive may appoint an administrative director separate from the health officer.
15 The administrative director appointed by the County Executive shall be subject to
16 confirmation by a majority of the County Council. The administrative director
17 shall be appointed for an indefinite period and shall serve at the will of the
18 County Executive.
19 B.. Health Officer. In accordance with R.C.W. 70.05.050, the County .
20 Executive may appoint a local health officer who shall meet the qualifications as
21 prescribed in R.C.W. 70.05.050 through R.C.W. 70.050.55. No term of office shall
22 be established for the health officer, but the health officer shall not be removed
23 from office until after notice is given and an opportunity for a hearing before the
24 County Executive as to the reason for the officer's removal is provided. The
25 health officer appointed by the County Executive shall be subject to confirmation
26 by a majority of the County Council.
27 24.01.040 Powers and duties of administrative officer, is deleted in its entirety
28 and replaced with:

1 A. Administrative Director. The duties of the administrative director shall be
2 as outlined in R.C.W. 70.05.045, as well as general management, oversight and
3 administration of the Health Department.
4 It is the responsibility of the administrative director to hire departmental staff,
5 except for health officer, in accordance with the personnel policies and procedures
6 of the County and any other applicable laws and regulations.
7 B. Health Officer. The powers and duties of the health officer shall be as
8 outlined in R.C.W. 70.05.070.
9 If no administrative director has been appointed, as provided in Section
10 24.01.030(A), the health officer, under the direction of the County Executive shall
11 have the powers and duties as outlined in R.C.W. 70.05.070 and the powers and
12 the duties of the administrative director as outlined in Section 24.01.040 (A).
13 If an administrative director is appointed in accordance with Section 24.01.303
14 (A), the health officer shall have the powers and duties as outline in R.C.W.
15 70.05.070 under the direction of the administrative director.
