IN THE MATTER OF GRANTING AN AMENDMENT FOR
THE PURPOSE OF MODIFICATIONS AND ADDITIONS TO
ORDINANCE NO. 92 -001 GRANTING A NON - EXCLUSIVE
FRANCHISE TO BLACK ROCK CABLE, INC. PURSUANT
TO STATE LAW AND SECTION 9.30 OF THE WHATCOM
COUNTY HOME RULE CHARTER, TO OPERATE AND
MAINTAIN A CABLE COMMUNICATION SYSTEM
WITHIN SPECIFIED AREAS OF WHATCOM COUNTY.
WHEREAS, Black Rock Cable, Inc. having heretofore applied for additions and
modifications to its twenty -five (25) year franchise to install, operate and maintain a cable
communication system along those certain roads in Whatcom County, Washington, and
notices of this hearing having been duly published on the 22n(ftay of October . , 19 94
and on the 99fbday of October , 1994 , in the Bellingham Herald, a newspaper having
county -wide circulation, and it appearing to the County that said notices of said hearing have
been given as required by law, and that it is in the public interest to grant the modifications
and additions to said franchise:
19 NOW, THEREFORE, BE IT ORDAINED by the Council of Whatcom County,
20 Washington, that Ordinance No. 92 -001, the non - exclusive franchise heretofore granted to
21 the said Black Rock Cable, Inc. be and the same is hereby amended and the additions and
22 modifications herein shall be subject to the same terms and conditions granted to said Black
23 Rock Cable, Inc., the same to apply to maintenance and operation and construction of
24 television cable lines on, under, along, and over the following described public county roads
25 and rights -of -way in Whatcom County, Washington, to -wit:
26 Sections 4, 5, 6, 7, 8, 9, 16, 17, Township 38N Range 5E
27 18, 19, 20, 21, 28, 29, 30, 31,
28 32, and 33
29 Sections 4, 5, 6, 7, 8, 9, 16, 17, Township 37N Range 5E

This franchise is granted upon the express terms and conditions that appear in the

original franchise dated the 7th day of January,
1992 and subject to all of the rights,

privileges and conditions therein contained.
The extension of service area authorized by this

amendment may be subject to change dependent upon the outcome of the negotiations with
13
TCI.
