Ord. #96 -063 Related File Numbers: Ordinance or Resolution Number (this item only): D r,j .-Vp 9(P -Q47�> 1 Lyndpark.ord 11 /20 /% SPONSORED BY: Consent AB96 -415 PROPOSED BY: Consent INTRODUCTION DATE: 11/26/96 ORDINANCE NO. 96 -063 IN THE MATTER OF THE FORMATION OF THE LYNDEN REGIONAL PARK AND RECREATION DISTRICT WHEREAS, the Whatcom County Council, being officers designated by law and constituting the Canvassing Board in and for Whatcom County to canvass the votes cast for and against Lynden Regional Park and Recreation District at an election held on November 5, 1996 in said Park and Recreation District; and, WHEREAS, the Canvassing Board certified that a total of 7320 votes were cast; that 3161 had been cast for the formation of the District and 1379 votes cast against the formation of the District; and, WHEREAS, the votes cast for Commissioners for the Lynden Regional Park and Recreation District were, District #1: Hank Roorda, received 2491 votes; District #2: Ron Van Soest received 3940 votes; District #3: Richard L. Waldemar, Jr. received 3043 votes; District #4: Curtis E. Maberry received 2572 votes; and District #5: Terry DeValois received 4206 votes. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that, as a result of said election, the following described territory is now duly organized as Lynden Regional Park and Recreation District: The exterior boundaries of the proposed park and recreation district are those of Lynden School District #504 as set forth as follows: Beginning at a point where the north and south center line of Section 31, Twp. 41 N., R. 2 E. crosses the International Boundary Line and running east to the north and south center line of Sec. 36, Twp. 41 N., R. 3 E.; thence south along said center line of said Sec. 36, and the center line of Sec. 1 and Sec. 12, Twp. 40 N., R. 3 E. to the center of Sec. 12, Twp. 40 N., R. 3 E.; thence west to the west line of said Sec. 12; thence south to the center line of the main channel of the Nooksack River; thence northwesterly along said center line of said River to a point where said center line of said River crosses the north and south center line of Sec. 26, Twp. 40 N., R. 3 E.; thence along the center lines of Secs. 26, and Sec. 35, 40 N., R. 3 E. And Sec. 2, 11, and 14, Twp. 39 N., R. 3 E. to the center of Sec. 14 Twp. 39 N., R. 3 E.; thence west to the center of Sec. 15, Twp. 39 N., R. 3 E.; thence north to the north line of Sec. 10, Twp. 39 N., R. 3 E.; thence west to the southwest corner of Sec. 5, Twp. 39 N., R. 3 E.; thence north to the southeast corner of the northeast quarter of Sec. 6, Twp. 39 N., R. 3 E.; thence west to the west line of said Sec. 6; thence north along the Twp. Line between R. 2 E. and R. 3 E. to a point where the I west line of Sec. 31, Twp. 40 N., R. 3 E. crosses the center line of the main channel of the 2 Nooksack River; thence southwesterly, southerly, and westerly along the center line of the 3 main channel of the Nooksack River to a point where said center line of said River crosses 4 the north and south center line of Sec. 34, Twp. 40 N., R. 2 E.; thence north to the center 5 of said Sec. 34; thence west to the southwest corner of the southeast quarter of the 6 northeast quarter of Sec. 32, Twp. 40 N., R. 2 E.; thence north to southeast corner of the 7 southwest quarter of the northeast quarter of Sec. 20, Twp. 40 N., R. 2 E.; thence west to 8 the center of Sec. 20, Twp. 40 N., R. 2 E.; thence north to the southeast corner of the 9 northeast quarter of the northwest quarter of Sec. 8, Twp. 40 N., R. 2 E.; thence west to 10 the west line of said Sec. 8;'thence north to the southeast corner of the northeast quarter 11 of the southeast quarter of Sec. 6, Twp. 40 N., R. 2 E.; thence west to the north and south 12 center line of said Sec. 6; thence north along the center line of Sec. 6, Twp. 40 N., R. 2 E. 13 and Sec. 31, Twp. 41 N. Lynden District is 68 square 14 miles in extent. 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 BE IT FURTHER ORDAINED, that Hank Roorda, first district; Ron Van Soest, second district; Richard L. Waldemar, Jr, third district; Curtis E. Maberry, fourth district; and Terry DeValois, fifth district are hereby declared to be the duly elected Commissioners of said Lynden Regional Park and Recreation District.
