1 ORDINANCE NO. 96 -057
2 AMENDING WHATCOM COUNTY CODE 20.92.120 REGARDING
3 DEPUTY HEARING EXAMINER
4 WHEREAS, on January 9, 1996 the Whatcom County Council voted unanimously to
5 terminate employment of the Whatcom County Hearing Examiner; and
6 WHEREAS, the County Council made the decision to contract out for hearing examiner
7 services on a temporary basis; and
8 WHEREAS, contracting out for these services has proved to be both an administratively and
9 fiscally responsible decision; and
10 WHEREAS, Whatcom County has not employed a deputy hearing examiner since the
11 late1980's; and
12 WHEREAS, when the contracted hearing examiner is not available, subcontractors, hereby
13 known as hearing examiners pro tempore, shall perform the duties of the hearing examiner.
14 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County. Council that Whatcom
15 County Code 20.92 be amended as follows:

17 The deputyzhearing examiner shall assist the hearing examiner in the
18 performance of the duties conferred upon them by this ordinance, and shall have all
19 of the duties and powers of the hearing examiner.
20 20.92.130 No interference with the hearing examiner.
21 No county official or any other person shall interfere with the hearing examiner or
22 deputy 1(?'1fj(3r hearing examiner in the performance of his or her designated
23 duties.
24 20.92.140 Qualifications.

25 The hearing examiner and his deputy rt„ shall be appointed solely with
26 regard to their qualifications for the duties of their office, and shall have such training
27 or experience as will qualify them to conduct administration of quasi-judicial hearings

1 on the application of regulatory enactments and to discharge other functions conferred
2 upon them, and shall hold no other appointed or elected public office or position in
3 the county government, except as provided in this ordinance.
