As a first step in this strategy, staff worked with a consultant to develop a preliminary list of changes related to Title 20 and Title 21 to clarify existing code language. Planning Commission unanimously recommended approval of the request, although several items were determined to be more substantive in nature and will be held for review during Phase II when more substantive changes will be studied. ORIGINATOR'S RECOMMENDED ACTION: The Director of Planning and Development Services recommends Council accept this recommendation of the Planning Commission. WHEREAS, in March 1995, the Whatcom County Council directed staff to develop a regulatory reform strategy; and WHEREAS, The first phase of the regulatory reform strategy is to clarify existing code language by eliminating conflict and duplication in code language; and WHEREAS, staff, working with a consultant, developed a preliminary list of changes related to Titles 20 and 21, to clarify existing code language; and WHEREAS, pursuant to RCW 36.70.590 legal notice was published in the Bellingham Herald on September 26, 1996; and WHEREAS, the Deputy SEPA Official has determined that the proposed changes are exempt from SEPA review pursuant to WAC 197-11-800(20); and WHEREAS, the Land Use and Planning Divisions of the Planning and Development Services Department played a key role in the development of the recommended changes to the code; and WHEREAS, the Planning Commission held a public hearing and work session on October 10, 1996, and addressed the proposed amendments and considered all testimony; and WHEREAS, the Planning Commission unanimously recommended approval of the request; and WHEREAS, the Council held a public meeting on November 26, 1996 to consider this matter and approved the Planning Commission's recommendation; and WHEREAS, the Council found the amendments in the best interest of the public health, safety, and welfare; and Page 1 WHEREAS, the Council has adopted the following Findings and Conclusion: FINDINGS 1. The Land Use titles of Whatcom County Code currently include language that is duplicative and conflicting with other language. 2. A regulatory reform strategy has been developed that is designed to correct errors, improve readability and efficiency in the Land Use titles of the county code. 3. The first step in the regulatory reform strategy is the "code scrub," a general clean up of existing Land Use titles for clarity in code language. 4. The text changes will not result in more restrictive regulation. 5. There are no substantive policy issues involved in the proposed changes. 6. The minor text changes will clarify meaning by adding or deleting certain words in the text. 7. The text changes will make language consistent with most current state statutes. 8. The text changes will make language consistent with subsequently adopted county statutes. 9. The text changes will correct obvious flaws or errors in syntax that yield unreasonable conclusions or interpretations. CONCLUSION The proposed code scrub changes are a necessary first step in Whatcom County's initiative to improve the readability and efficiency of the Whatcom County Code. Titles 20 and 21 will be significantly improved by these changes. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section 1. Title 20 and Title 21 of Whatcom County Code shall be amended as indicated in Attachment A. Section 2. the revised expiration and extension provisions adopted herein for plats (WCC 21.20.1 10) and planned unit developments (WCC 20.85.355) shall apply to all new and to all previously approved and unexpired planned unit developments and plats. Section 3. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the ordinance as a whole or any part thereof other than the part so declared to be invalid.
