They are requesting the removal of item #6 only, which restricts the use to a motel or hotel. The land is being considered for other service oriented uses for the area in addition to lodging. The Concomitant Agreement stipulates that any amendments or modifications are valid only if agreed upon by the County Council following a public hearing. The amendment does not require any additional SEPA review or Planning Commission review since this occurred with the original application. ORIGINATOR'S RECOMMENDED ACTION: The Director of Planning & Development Services recommends the Council amend the Agreement as requested. Based upon these Findings of Fact, it is declared that enactment of this ordinance will promote the public health, safety and general welfare. NOW THEREFORE BE IT ORDAINED BY THE WHATCOM COUNTY COUNCIL: Section 1. The 1991 Tracy Rezone Concomitant Agreement, attached as Exhibit A, is 1f_; �--vo . - - i f 2 3 4 5 6 7 6 Page 2 hereby amended by striking provision #6, which states that "The 5.11 acre parcel will support a motel /hotel use only." Section 2. This action shall not become effective until and unless all parties have signed the revised concomitant agreement and the agreement has been recorded in the Whatcom County Auditor's office. Section 3. WHEREAS, the undersigned parties designated Owners are the owners of those certain parcels of real 12 property (hereinafter called the "subject properties ") located in Whatcom County, which parcels are shown on a map and 13 more fully described in Attachment "1" attached hereto; and 14 H. WHEREAS, Owners have applied for a zoning reclassification of the subject properties from RURAL - 15 FIVE ACRE and NEIGHBORHOOD COMMERCIAL to TOURIST COMMERCIAL and the Planning Commission has 16 recommended in favor of such reclassification with conditions; and 17 M. WHEREAS, the County has authority to enact laws and enter into agreements to promote the health; 18 safety and welfare of its citizens and thereby control the use and development of property within its jurisdiction; and 3 IV. WHEREAS, Owners have voluntarily agreed to enter into this Concomitant Zoning Agreement in order 10 to obtain the approval of the County for their application for reclassification of the Subject Properties; 21 NOW, THEREFORE, in consideration of the Council's enactment of an ordinance reclassifying the Subject 22 Properties from Rural -Five Acre (RS -A) and Neighborhood Commercial to Tourist Commercial, the Owners do hereby 23 covenant and agree, on behalf of themselves and their successors and assigns, as follows: 24 1. Existing access and parking for. the store (Parcel B) will be eliminated and rechanneled through the proposed 25 development site. 26 2. On the 5.11 acre parcel (Parcel A), Owners will provide a 50' natural buffer on Kendall Road and a 25' natural 27 buffer on Mt. Baker Highway. 28 3. Prior to approval of any development of Parcel A, the Technical Review Committee will meet to review the site 29 plans in respect to access to the parcel and adjoining store and to assure that the project is in keeping with the rural. 30 character of the area. 31 4. Rechannelization of the Kendall Road and Mt. Baker Highway intersections may need to take place in accordance 32 with Washington State Department of Transportation guidelines. 33 S. Owner will assure that the lease of the adjacent Kendall Store is not violated by the terms of this concomitant 34 agreement. _ 35 6.
