This ordinance would allow the Administration to exercise options contained in contracts, which have already been approved
by Council vote, from having to go through the Council again. Currently, the Council reviews the exercise of options even
though they already had previously approved the inclusion of the option. This results in a duplication of effort and uses
valuable Council time.
RECOMMENDED MOTION (for final action):
I move to approve the ordinance.

ALLOWING EXERCISE OF CONTRACT OPTIONS WITHOUT FURTHER COUNCIL
REVIEW
WHEREAS, Whatcom County Code Section 3.08. 100 requires Council approval of
certain contracts, bids and leases; and
WHEREAS, the County on occasion negotiates contracts and leases with options to
extend such instruments for an additional term; and
WHEREAS, when the Council provides approval for such contracts and leases they are
aware of the options contained in them and the costs that will be incurred; and
WHEREAS, the subsequent review of the same contract or lease by the Council merely
because of the exercise of an option already contained in the previously approved contract results
in an unnecessary duplication of effort on the part of the Council and staff,
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that WCC
3.08. 100 is hereby amended as follows:
3.08.100 Council approval required.
Contracts for professional services exceeding $15,000, bids exceeding $35,000 and all real
property leases must be submitted to the county council for approval, except when made in the
exercise of an option contained in a contract or lease previously approved by the council
