INTRODUCTION DATE: 5 /14 / 9 6 1 ORDINANCE NO. 96-021 2 AN ORDINANCE OF WHATCOM COUNTY, WASHINGTON 3 DEFINING PROCEDURES FOR THE SEGREGATION 4 OF INDIVIDUAL PARCELS OF PROPERTY 5 WITHIN LOCAL ROAD IMPROVEMENT DISTRICTS TO 6 DETERMINE TAX ASSESSMENT RATE 7 WHEREAS, Local Road Improvement Districts (LRID) are comprised of a group of 8 property owners who collectively agree with the County to finance a road by means of a tax 9 based on market valuation of the individual properties, and 10 WHEREAS, in some instances certain parcels of property subsequently need to be 11 segregated into smaller subdivided parcels, and 12 WHEREAS, certain segregations may involve open space requirements in which 13 Whatcom County has a financial interest to be protected, 14 WHEREAS, the administration has found it necessary to set forth procedures for the 15 segregation of individual parcels of property within LRID's to apply uniformly to all LRID's 16 in the County, 17 NOW, THEREFORE, BE IT ORDAINED procedures shall be followed in the 18 segregation of properties within all LRID's in Whatcom County: 19 20 21 22 23 24 25 26 27 28 92 30 31 32 1. Five copies of the applications for segregation will be filed with the Clerk of the Council. The Clerk will distribute applications to the Treasurer, Assessor, and two copies to the Director of Public Works. County staff will be allowed two weeks to review the application prior to it being placed on the Council's Finance Committee agenda. Before placing the application on the agenda, the Clerk of the Council will confirm with the aforementioned offices that the application is in order. If the application is not in order the Clerk will schedule a meeting of the affected offices to resolve the problems with the application. With input from the County's staff, the Clerk will draft the resolution approving the segregation and distribute copies to the Treasurer, Assessor, Public Works Engineering and Public Works Administration. 2. Segregation shall be accompanied by a map: (A) Identifying the location of all boundaries (of all assessments and all taxing districts) . (B) Identifying the location of LID or LRID zone boundaries (if any). Page 1 1 (C) Showing the area in square feet of all zones and districts within 2 each parcel with a separate computation by district for parcels that fall 3 within multiple assessment districts. 4 (D) Where possible identifying boundaries and areas of common area and /or 5 open space. 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 3. The ratio of the value of a parcel, as determined by two separate sources (i.e. assessed value, short form appraisal, recent selling price) of the parcel before segregation shall not be required to be the same after the segregation for each segregated parcel. If the post - segregation value, again as determined by two separate sources, drops significantly from the pre- segregation value and appears to approach a 4:1 ratio -- or there is contradictory evidence between the two valuation sources which suggests a 4:1 ratio or lower may apply -- the County may require an appraisal review. The proponent shall be liable for the cost of determining the pre- and post - segregation valuation and shall also be liable for the cost of an appraisal review if determined necessary by the County. The post- segregation assessment rate per square foot shall be uniform across the entire portion of each parcel lying within each separate assessment zone. 5. Any LRID assessment of $1,000 or less will be paid in full prior to the Whatcom County Treasurer making a segregation order. 6. Unless Whatcom County otherwise agrees in its sole discretion, assessments on parcels with 80% or more open space must be paid in full prior to Whatcom County Treasurer making a final segregation.
