ORDINANCE NO. 96 -011
2 ESTABLISHING STANDARDS FOR THE VESTING OF PROJECT PERAUTS AND
3 PROJECT PERAM APPLICATIONS
4 WHEREAS, Whatcom County is in the process of compliance with the State Growth
5 Management Act (GMA), RCW Ch. 36.70, including preparing a Comprehensive Plan and
6 Development Regulations in accordance with GMA requirements; and
7 WHEREAS, the incremental preparation and adoption of the Plan and Development
8 Regulations required by GMA has created and will continue to create changing regulatory
9 environment for land development, land use, and building construction for some time; and
10 WHEREAS, Whatcom County recognizes that within the parameters of the vesting
11 doctrine established by case law and statute in Washington state-, municipalities may develop
12 vesting schemes best suited to the needs of the particular locality; and
13 WHEREAS, as a matter of policy Whatcom County Council has long recognized the
14 vesting -of a number of project applications which have substantial submittal requirements
15 including but_ not limited to building permits, subdivisions, binding site plans, planned unit
16 developments, major development permits, conditional use permits, but has not formalized this -.
17 through a vesting ordinance; and
.18 WHEREAS, it is the desire of the Whtacom County Council to formalize its vesting
19 policy for the benefit of the public in determining the applicable substantive review standards for
20 project permits that have been approved, and for applications for pro_ ject permits that are currently
21 under review or may be- proposed in the future; and
22 WHEREAS, the Whatcom County Council finds the vesting of project permits and
23 applications to be an issue of concern both to property owners as well as the general public and
24 one that should be clarified by ordinance.
25 NOW, THE_ REFORE, BE IT ORDAINED by the Whatcom County Council that:
