The county has adopted an ADA plan which lists structural changes to.facilities that will be undertaken over a 5 -year
period to achieve program accessibility. The plan. recommends that the county `establish a policy that the ADA
,)rdinator work with the department ADA liaisons and with the ADA committee each year from 1995 through 1999
Lo determine the priority of ADA projects and submit them to the Executive for budgetary consideration'. The ADA
committee requests that this policy be adopted, and that the committee's role be broadened to act as an advisory
council to the Executive regarding accessibility issues. Adopting this ordinance will allow the Executive to make better
use of the existing ADA committee, and will ensure input from the community of people with disabilities in setting
ADA budget priorities for the following year.

INTRODUCTION DATE: 2/20/96
ORDINANCE NO. 96 -010
WHEREAS, Title II of the Americans with Disabilities Act of 1990 requires Whatcom County to make
its programs accessible to persons with disabilities; and
WHEREAS, the County Executive, as the chief person responsible for ensuring that county building
projects comply with federal and state ADA requirements, has appointed an ADA Coordinator; and
WHEREAS, Whatcom County Ordinance No. 92 -048 has established the ADA Compliance Committee
to hear appeals to the ADA Coordinator's decisions regarding allegations of discrimination; and
WHEREAS, the Whatcom County Council has adopted the Whatcom County ADA Transition Plan
and Self Evaluation Plan on August 15, 1995; and
WHEREAS, the plan lists structural changes to facilities that will be undertaken over a five -year period
to achieve program accessibility; and
WHEREAS, the Council recognizes that the order of priorities on the implementation schedule of this
plan is tentative, and that therefore additions, deletions, or changes may be necessary in the future;
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that
The Executive shall direct each department and division to appoint an ADA liaison who will provide
annually to the ADA Coordinator a list of accessibility problems to be considered for budgetary needs; and
The Executive shall direct the ADA Coordinator to work with the ADA Compliance Committee to
determine the priority of ADA projects and submit them to the Executive for budgetary consideration; and
The scope of the ADA Compliance Committee's role shall be broadened to act as an advisory council
to the Executive regarding ADA compliance issues; and
Monies identified by the Council to be used for accessibility purposes shall not be diverted to other
purposes.
BE IT FURTHER ORDAINED THAT the original .ordinance Number 92 -048, along with this
amendment, be codified in the Whatcom County Code and the Clerk of the Council is to develop the
appropriate chapter and section numbers and titles as necessary.
