Amendments to WCC 24.06, sewage sludge regulations, are necessary to make them consistent with the recently enacted
Compost Quality Regulations (WCC 24.09) and. the federal sewage sludge rules, 40 CFR Part 503. Amendments to the
existing sewage sludge regulations were to be enacted concurrently with the compost quality regulations. Due to an
oversight the sewage sludge regulations were not amended.

ORIGINATOR'S RECOMMENDED ACTION.•
The Health Officer recommends the Council approve a motion authorizing the proposed changes to WCC 24.06 in order
to make them consistent with the recently promulgated Compost Quality Regulations, WCC 24.09, and the federal sewage
sludge rules, 40 CFR Part 503.

2 AMENDING THE WHATCOM COUNTY HEALTH CODE, CHAPTER 24.06,
3 SEWAGE SLUDGE REGULATIONS
4 WHEREAS, on November 28, 1995 the Whatcom County Council amended the
5 Whatcom County Health Code by creating Chapter 24.09, Compost Quality Regulations;
6 and
7 WHEREAS, the Whatcom County Health Code also contains Chapter. 24.06,
8 Sewage Sludge Regulations; and
9 WHEREAS, in order to avoid double regulation, amendments must be made to
10 Chapter 24.06, Sewage Sludge Regulations; and
11 WHEREAS, the Whatcom County Health Department has submitted amendment
12 language for Chapter 24.06, Sewage Sludge Regulations, related to composted sewage
13 sludge;
14 NOW THEREFORE BE IT ORDAINED by the Whatcom County Council that
15 Chapter 24.06 of the Whatcom County Health Code is amended as outlined in "Exhibit
16 A" to this ordinance.

PROPOSED CHANGES TO WCC 24.06
The Whatcom County Health Department recommends the addition of the following as
amendatory text to WCC Section 24.06.030. This amendatory language is necessary to make
WCC 24.06 consistent with both the recently enacted Compost Quality Regulations (WCC 24.09)
and the federal Standards for the Use or Disposal of Sewage Sludge (40 CFR Part 503).
WCC 24.06.030 Solid waste disposal standards.
A. General Provisions.
1. State Standards.
2. Local Standards - Purpose and Intent.
3. Composted Municipal Sewage Sludge. Subject to 40 CFR Part 503.10(c)(2„Lor
any parallel state regulation implementing an EPA approved sludge management program relating
to bulk land application, this Chapter shall not apply to municipal sewage sludge/biosolids
composted in compliance with the registration requirements of WCC Section 24.09.060(c ) and all
other applicable federal and/or state regulations and permit conditions.
