REVISING WHATCOM COUNTY CODE 1. 10,
CLARIFICATION FOR DISPOSAL OF REAL PROPERTY
1 WHEREAS, RCW 36.34.005 authorizes counties to establish comprehensive procedures for
2 the management of county property;
3 WHEREAS, Whatcom County has established comprehensive procedures for the
4 management of county property in accordance with RCW 36.34.005;
5 WHEREAS, the established procedures do not provide for the demolition of county -owned
6 structures determined to be worthless;
7 WHEREAS, the need for such procedure has become apparent due to the existence of such
8 structures, one of which posed an immediate threat to the public;
9 WHEREAS, it is in the best interest of the public to establish a procedure for demolition of
10 worthless county -owned structures;
11 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that a new
12 section, Whatcom County Code Section 1.10.395, entitled "Worthless County -Owned Structures," be
13 added to chapter 1.10 of the Whatcom County Code as set forth in the attached Exhibit A.

EXHIBIT A
WORTHLESS COUNTY -OWNED STRUCTURES
All county department heads shall notify the director of administrative services of
county -owned structures deemed to be worthless. If the director determines a county -
owned structure to be worthless and immediately hazardous to the public, the director
shall notify the county executive. If the county executive concurs with the determination
of the director, the structure shall be demolished. The county executive shall notify the
county treasurer, the county assessor, and the county council of the demolition. If the
director determines a county -owned structure to be worthless, but not immediately
hazardous to the public, the director shall refer the matter to the county executive for
review. Upon a determination by the county executive that the property is in fact
worthless and without value, the matter shall be referred to the county council for its
approval prior to demolition.
