SUMMARY STATEMENT:
_ citizen petition initiated a paved shoulder on Birch Bay Drive, and
there is a tremendous amount of local support. In order for the paved
shoulder to provide congestion relief for bicyclists and pedestrians, it is
imperative that vehicles do not park there. For this reason, we have
worked extensively and design modifications to insure that private
parking will not be obstructed by this ordinance. Passage of this
ordinance is the final step in insuring the public benefit is achieved by
this project.

RE: Birch Bay Drive No- Puking Ordinance
Enclosed please find a copy of a "No Parking on Paved Shoulder" ordinance on Birch Bay Drive.
This ordinance is intended to coincide with the construction of a paved shoulder that is currently
underway. The purpose of the ordinance is to keep vehicles off of the 4 foot paved shoulder once
it is constructed so that pedestrians and bicyclists have a safety buffer from road traffic in this busy
resort area. The sheriffs office is in support of this ordinance.
We have had 2 public meetings with adjacent property owners and have worked extensively with
design modifications to insure that property owners will not be adversely affected by this ordinance.
We have mitigated on- street parking limitations for those citizens with no other parking
alternative by relocating the centerline of the road in specific places along the project. In
addition, we will be adding paved parking on existing undeveloped road ends for use as auxiliary
parking in the area.
Please include this item in the Council agenda for introduction at their meeting scheduled for
Mayl8,1999, and for public hearing on June 1, 1999. If you have any questions, please don't

2 AN ORDINANCE REGARDING ESTABLISHING PARKING CONTROL
3 ON BIRCH BAY DRIVE AND BIRCH POINT ROAD

5 WHEREAS, the Whatcom County Council is authorized under RCW 46.61.570 to
6 restrict parking on certain County roads; and
7
8 WHEREAS, a traffic engineering study was conducted by the County Engineer's
9 office; and
10
11 WHEREAS, conditions on the roadway during peak summer season have been found to
12 be congested and unsafe for the non - motoring public; and
13
14 WHEREAS, a County road project is underway that will widen and pave the shoulders on
15 said road throughout the limits described herein.

17 NOW, THEREFORE, BE IT ORDAINED that a "No Parking On Paved Shoulder" zone
18 be established on Birch Bay Drive, from Point Whitehom Road, north through Birch Bay Park to
19 Shintaffer Road, and Birch Point Road from Shintaffer Road to Birch Point Loop Road, located
20 within Sections I and 2, Township 39 North, Range 1 West of W.M.; Section 36, Township 40
21 North, Range 1 West of W.M.; and Sections 23,24,30, and 31, Township 40 North, Range 1 East
22 of W.M; EXCEPT for existing designated parking areas.

24 BE IT FURTHER ORDAINED that the County Engineer is hereby directed to install the
25 appropriate signs as construction is completed, and that the Whatcom County Sheriff and the
26 Washington State Patrol be notified by a copy of this ordinance.

28 Provisions of this ordinance are hereby added to Whatcom County Code, Section 10.24.
