CONSENT PROPOSED BY..' PLANNING DATE: MARCH 9. 1999 ORDINANCE NO. 99 -013 AN ORDINANCE ESTABLISHING COMPREHENSIVE PLAN DESIGNATIONS AND TITLE 20 ZONING FOR THOSE FEE LANDS WITHIN THE MT. BAKER SNOQUALMIE NATIONAL FOREST WHEREAS, the County Council adopted an Emergency Ordinance to establish Comprehensive Plan designations and Title 20 zoning for the exclaves within the Mt. Baker National Forest on 1- 15 -99, and directed the Planning Commission to conduct a public hearing on these designations; and WHEREAS, the Planning Commission conducted a duly advertised public hearing on February 25, 1999, considered all public testimony and recommended approval of these designations; and WHEREAS, a Determination of Non - Significance was issued by the Deputy SEPA Official on December 17, 1997: and WHEREAS, the Whatcom County Council adopts the following Findings and Conclusions: FINDINGS 1. Pursuant to RCW 36.70.790, Whatcom County adopted an Interim Zoning Ordinance on July 6, 1972, which has been repeatedly extended for 25 years. Areas applicable under Chapter 2.24A include the fee lands within the National Forest, Wilderness and Recreation Areas. 2. In order to assure continued regulation of land use and provide predictability to land owners and consistency with zoning in other areas, the adoption of permanent zoning for the fee lands is necessary. 3. On January 12, 1999, the Whatcom County Council adopted Emergency Ordinance 99 -002 Establishing Title 20 zoning for 60 days and directing the Planning Commission to conduct public hearings on this zoning. 4. Public notice was mailed to the subject property owners, interested parties and property owners within a 300' radius of the subject site on February 12, 1999, published in the Bellingham Herald on February 11, 1999. Notice was not posted at the site due to its remote location and deep snow. 5. Determination of Non - Significance was issued by the Deputy SEPA Official on December 17, 1997 6. The Whatcom County Comprehensive Plan Goals support the designation of Commercial and Rural Forestry zoning on forested lands and Mineral Resource Overlay zoning on lands with active mining claims. 7. The zoning districts shown on Exhibits 1 -4 are consistent with existing and potential use of these areas. PlanninglRezones10897zt.forestemerg .doc FILE REF 8 -97 .,ZT Page 2 CONCLUSIONS Adoption of the zoning and Comprehensive Plan designations shown on Exhibits 1 -4 is consistent with the Growth Management Act, the Whatcom County Comprehensive Plan, existing use of the property, and the protection of public health, safety, morals or welfare. THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section 1. That the Comprehensive Plan map and zoning designations shown on the attached Exhibits 1 -4 are adopted for the fee lands within the Mt. Baker/ Snoqualmie National Forests. Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid.
