ORDINANCE NO. 99 -012
AN ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY ZONING
ORDINANCE, TITLE 20, TO ADD A NEW CHAPTER 20.61 - SMALL TOWN
COMMERCIAL DISTRICT (STC) AND AMENDING THE OFFICIAL WHATCOM
COUNTY ZONING MAP FROM GC, NC, TC, RC, RR2, R2A, R5A AND R10A TO STC;
UR4 TO RRI; R5A TO RR2; RC TO RRI; AND RC TO RF.
WHEREAS, by Resolution No. 98 -063, the Council initiated emergency amendments
to Title 20 to map areas and add chapteA establishing Small Town Commercial and Crossroad
Commercial zoning districts; and
WHEREAS, pursuant to RCW 36.70.590 legal notice was published in the Bellingham
Herald on Thursday, January 14, 1999; and
WHEREAS, the Deputy SEPA Official issued a Determination of Non - Significance on
January 14, 1999; and
WHEREAS, the Planning Commission held a public hearing on the proposed
amendments on January 28, 1999; and
WHEREAS, the Planning Commission held a work session on the proposed
amendments and recommended approval on February 11, 1999; and
WHEREAS, the Council held a public meeting on March 23, 1999 and approved the
Planning Commission recommendation; and
WHEREAS, the Council found the amendments in the best interest of the public
health, safety, and welfare; and
WHEREAS, the Council has adopted the following Findings and Conclusions:
FINDINGS
1. Public notice was mailed to the subject property owners, interested parties and property
owners within a 300' radius of the subject sites on January 19, 1999 and posted at the
sites on January 15, 1999.

2. The proposal address the Small Towns of Acme, Custer, Deming, Glacier, Kendall and
Maple Falls. -
3. The current land uses within the subject areas include: single family residential,
commercial, public, utilities, woodland and vacant.
4. The surrounding areas generally contain rural forestry, commercial forestry, rural
residential and agricultural land uses. Within the immediate service areas of Kendall,
Maple Falls and Glacier are several large urban density Resort/Recreational Subdivisions.
5. GMA amendments (ESB 6094) were adopted in 1997, thus allowing more latitude for
infrll and expansion of existing areas of more intensive rural development.
6. On May 20, 1997, the Small Town designation and associated Small Town goals and
policies were approved with the adoption of the Whatcom County Comprehensive Plan.
7. On May 18, 1998, a public meeting was held at the Deming Log Show Pavilion to
discuss appropriate zoning for the Small Towns designated in the Comprehensive Plan.
S. The proposed Small Town Commercial District is within the character of the definition
and purpose of the Small Town designation as defined in the Comprehensive Plan.
9. The Comprehensive Plan Policies and the County-wide Planning Policies strongly
support existing Small Town commercial businesses and provision of a range of
commercial and rural industrial land uses that: provide family -wage jobs; serve the rural
trade area, and out -of -area tourists; and support the economic well -being of Whatcom
County's Small Towns.
10. The Growth Management Act and the 1997 ESB 6094 amendments regarding rural
development were adopted after the original subarea plans and zoning for these Small
Town areas.
CONCLUSIONS
The proposal is consistent with the goals and policies of Whatcom County regarding the
designation and provision of sufficient commercial and light industrial employment opportunities
necessary for future economic stability in Whatcom County's Small Towns. The proposal is
also consistent with the 1997 legislative amendments to the Growth Management Act which
allow more latitude for infill and expansion of existing areas of more intensive rural
development.

NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that:
Section 1. The Official Whatcom County Ordinance, Title 20, is hereby amended to include a
new Chapter 20.61 —Small Town Commercial District (STC). (Attached as ATTACHMENT 1)
Section 2. The Official Whatcom County Zoning Map is hereby amended from GC, NC, TC,
RC, RR2, R2A, R5A and R10A to STC; UR4 to RRI; R5A to RR2; RC to RRI; and RC to
RE within all designated Whatcom County Small Towns. (Attached as ATTACHMENTS 2 -7)
Section 3. Adjudication of invalidity of any of the sections, clauses, or provisions of this
Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof
other than the part so declared to be invalid.
ADOPTED this 23 day of MARCH , 1999.
