SUMMARYSTATEMENT:
'his emergency ordinance will establish Comprehensive Plan

designations and Title 20 zoning for the fee lands within the Mt.
Baker Snoqualmie National Forest for a period of 60 days or until
permanent ordinances are adopted. Ordinances to establish
permanent Comprehensive Plan designations and zoning for this area
has been introduced, bat cannot be adopted and in place before the
current emergency ordinance expire. The Director of Planning and
Development Services recommends adoption of this ordinance.

ORDINANCE NO. 99 -011
AN EMERGENCY ORDINANCE CONTINUING THE INTERIM COMPREHENSIVE PLAN
DESIGNATIONS AND ZONING FOR THOSE FEE LANDS WITHIN THE MT. BAKER
SNOQUALMIE NATIONAL FOREST
WHEREAS, the County Council adopted an Emergency Ordinance to establish Comprehensive
Plan designations and Title 20 zoning for the exclaves within the Mt. Baker National Forest on 1- 15 -99,
which is scheduled to expire on 3- 13 -99; and
WHEREAS, the Planning Commission has conducted a public hearing and made a
recommendation to the County Council regarding permanent zoning for the National Forest Exclaves, but
there is insufficient time for this ordinance to be adopted and in place before the Interim Ordinance
expires; and
WHEREAS, a Determination
of Non - Significance
was issued by the
Deputy SEPA Official on
December 17. 1997: and
WHEREAS, Section 2.40 of the Whatcom County Charter allows the adoption of an emergency
ordinance passed by a two- thirds vote of the County Council, which is effective immediately upon
signature by the County Executive; and
WHEREAS, based on the above findings, the Whatcom County Council declares that an
emergency ordinance is necessary for preservation of the public peace, health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that:
Section 1. That the Comprehensive Plan map and zoning designations shown on the
attached Exhibits 1-4 are adopted on an emergency basis for sixty days from adoption of this
Ordinance or until the effective date of an Ordinance adopting these designations on a permanent
basis.
Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this
Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than
the part so declared to be invalid.
