SUMMARYSTATEMENT:
This emergency ordinance will establish Comprehensive Plan
designations and Title 20 zoning for the fce lands within Lummi
Reservation for a period of 60 days or until permanent ordinances are
adopted. An ordinance to establish permanent Comprehensive Plan
designations and zoning for this area has been introduced, but cannot
be adopted and in place before the current emergency ordinance
expire. The Director of Planning and Development Services
recommends adoption of this ordinance.

ORDINANCE NO. 99 -010
AN EMERGENCY ORDINANCE ADOPTING COMPREHENSIVE PLAN DESIGNATIONS
AND TITLE 20 ZONING FOR THOSE FEE LANDS WITHIN THE LUMMI RESERVATION
WHEREAS, pursuant to RCW 36.70.790, Whatcom County adopted an Interim Zoning Ordinance
on July 6, 1972, which has been repeatedly extended and is scheduled to expire on March 13, 1999; and
WHEREAS, Whatcom County Planning Commission has conducted a public hearing and
recommended permanent zoning and Comprehensive Plan designations for the fee lands within the
boundaries of the Reservation, but there is insufficient time for a permanent ordinance to be adopted and
in place before the interim ordinance expires; and
WHEREAS, a Determination of Non - Signifcance was issued by the Deputy SEPA; and
WHEREAS, Section 2.40 of the Whatcom County Charter allows the adoption of an emergency
ordinance passed by a two- thirds vote of the County Council, which shall be effectively immediately upon
signature by the County Executive; and
WHEREAS, based on the above findings, the Whatcom County Council declares that an
emergency ordinance is necessary to preserve the public peace, health, safety and welfare; and
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that:
Section 1. That the zoning designations shown on the attached Exhibits A and B are
adopted on an emergency basis for sixty days from adoption of this Ordinance or until the effective
date of an Ordinance adopting these designations on a permanent basis.
Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this
Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than
the part so declared to be invalid.
