ADS Facindes Management ADS Finance ADS Human Resources ADS Info Service O)IGINATOR'S RECOMMENDED ACTION: Assmor Auditor Shirley Forslof Cooperative Extension Recommend adopting ordinance anoint Court iaeeuave Health Hearing Examiner Jail COUNCIL ACTION TAKEN: 1999 -a9 ?123199: Introduced 319199: Adopted 7 -0, Ord. 099-006 Juvenile Parks Planning Prosecutor Public Works She n ;rWd Q! of 7 INTRODUCED BY: CONSENT PROPOSED BY: AUDITOR DATE: 2/23/99 ORDINANCE NO. 99- 006 AN ORDINANCE ESTABLISHING WHATCOM COUNTY VOTING PRECINCTS WHEREAS, due to numerous annexations by cities within Whatcom County over the past several years, precinct boundary changes need to be made; and, WHEREAS, the County Auditor has discovered errors in legal descriptions of many precinct boundaries; and, WHEREAS, errors exist in precinct ordinances; and, WHEREAS, numerous legal descriptions of precinct boundaries need updating through elimination of references to obsolete landmarks and more precise boundary descriptions; and, WHEREAS, clarification is needed that all precinct boundaries are established pursuant to the authority of the County Council; and, WHEREAS, state law mandates in R.C.W. 29.04.040 (3) that precincts in which voting machines or electronic voting devices are used may contain as many as nine hundred registered voters; and, WHEREAS, a single ordinance establishing the legal boundaries for all precincts within Whatcom County is needed to promote simplicity and uniformity, and to facilitate recording subsequent precinct boundary changes, WHEREAS, state law mandates in RCW 29.04.040 (2) that no precinct boundaries may be changed during the period starting on the thirtieth day prior to the first day for candidates to file for the primary election and ending with the day of the general election and, WHEREAS, the first day for candidates to file in person is July 26, 1999 and the precinct boundaries most be established by June 25, 1999 and time is needed for the necessary procedural steps such as legislative authority approval, notification of voters, production of maps, and notification to the Secretary of State. Precinct Legal Descriptions - 1999 NOW THEREFORE, BE IT ORDAINED that: 1. All ordinances or portions thereof establishing voting precinct boundaries in Whatcom County enacted prior to this ordinance are hereby repealed. 2. A single ordinance establishing all voting precincts in Whatcom County is hereby enacted and shall read as set forth in the attached Exhibit "A ", which is fullyincorporated herein.
