This emergency ordinance will continue the interim zoning for the fee lands on the Lummi Reservation for 60 days until Tilte 20 zoning can be adopted. It will expire in 60 days or when a permanent ordinance is adopted. The Director of Planning and Development Services recommends adoption of this ordinance. CONSENT PROPOSED BY PLANNING DATE: 1/12/99 ORDINANCE NO. 99 -001 AN EMERGENCY ORDINANCE EXTENDING THE INTERIM ZONING FOR THOSE FEE LANDS WITHIN THE LUMMI RESERVATION WHEREAS, pursuant to RCW 36.70.790, Whatcom County adopted an Interim Zoning Ordinance on July 6, 1972, which has been repeatedly extended for 25 years and is scheduled to expire on January 10,1999;and WHEREAS, areas applicable under Chapter 2.24A include the fee lands within the Lummi Reservation; and WHEREAS, Whatcom County has been working cooperatively with the Lummi Nation to develop compatible zoning on a permanent basis within the boundaries of the Reservation; and WHEREAS, in order to assure continued regulation of land use and provide predictability to land owners, the adoption of permanent zoning is necessary; and WHEREAS, a Determination of Non - Significance was issued by the Deputy SEPA; and WHEREAS, RCW 36.70.795 allows the adoption of official controls prior to a public hearing if such hearing is held within 60 days of its adoption; and WHEREAS, based on the above findings, the Whatcom County Council declares that an emergency ordinance is necessary for preservation of the public peace, health, safety and welfare; and WHEREAS, the Whatcom County Council has indicated a desire to adopt Title 20 zoning for the Lummi Reservation, options for Title 20 zoning will be provided by the Department of Planning and Development Services during the 60 day period that the Emergency Ordinance is in effect; NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section 1. That the zoning designations shown on the attached Exhibits A are adopted on an emergency basis for sixty days from adoption of this Ordinance or until the effective date of an Ordinance adopting these designations on a permanent basis. Section 2. The Whatcom County Planning Commission shall hold a public hearing concerning such emergency zoning regulations and options for Title 20 zoning within thirty (30) days from adoption of this Ordinance. Section 3. Adjudication of invalidity of any of the sections, clauses, or provisions of this Drdinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than :he part so declared to be invalid.
