ORDINANCE NO. 98 -075
AMENDING WHATCOM COUNTY CODE CHAPTER 17.20, FLOOD CONTROL
MAINTENANCE PROGRAM
WHEREAS, on June 17, 4997, the Whatcom County Council adopted Ordinance 97 -027,
repealing Ordinance 84 -059 and re- establishing provisions to carry out a flood control
maintenance program in accordance with RCW 36.89, 86.12, 86.15, 86.18, and 86.26, and
creating Whatcom County Code Chapter 17.20; and
WHEREAS, the Whatcom County Council finds that Whatcom County Code Chapter
17.20 places a burden on some property owners which may prevent them from completing
significant flood prevention projects; and
WHEREAS, all county residents benefit from the completion of these projects; and
WHEREAS, it will cost county taxpayers substantially more in repair work after flood
events if these projects are not complete; and
WHEREAS, the cost of fish mitigation has been thrust upon Whatcom County by the
State without state funding; and
WHEREAS, fish mitigation costs may interfere with a property owner's financial ability
to do necessary flood prevention projects.
NOW THEREFORE BE IT ORDAINED by the Whatcom County Council that Whatcom
County Code Chapter 17.20, Flood Control Maintenance Program, is amended as follows:
17.20.020 County participation.
