ORDINANCE NO. 98-061
IN THE MATTER OF AMENDING WHATCOM COUNTY CODE 2.09
WHEREAS, it is the desire of the Whatcom County Council to reactivate the Public Defense
Advisory Committee as established in Whatcom County Code 2.09.090; and
WHEREAS, County Ordinance 84 -22 Section 2 is in conflict with the Whatcom County
Charter as it relates to WCC 2.09.030 and 2.09.090(D); and
WHEREAS, the Whatcom County Code can be brought into conformance with the following
amendments;
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the
Whatcom County Code, Chapter 2.09.030 be amended as follows:
"2.09.030 Functions, duties, and powers.
"The functions, duties, and powers of the office of the public defender shall be
prescribed by RCW chapter 36.26, and other applicable laws of the state . of Washington and
Whatcom County, that as of F ruary 1, 1988,
not pailieipate in an�, new dependeney petitions either- as eounsel of the el4ld or parents vi�ut
having an agreement with the state of Wasf4ngten for- r-eimbufsement for- its eests."
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the
Whatcom County Code, Chapter 2.09.090 be amended as follows:
"2.09.090 Advisory Committee.
"There is established a public defense advisory committee which shall be composed
of:...
"D. One non lawyer appointed by the county eeunei 1 executive."

NOW, THEREFORE, BE IT ORDAINED that unless specifically amended in this
Ordinance, all other provisions of Whatcom County Code 2.09 shall remain in full force and effect.
