2 IN THE MATTER OF ACCEPTING
3 VIEW HAVEN LANE AS A PUBLIC ROAD
4 WHEREAS, on August 11, 1998, pursuant to the procedures contained in RCW 36.81,
5 the County Council adopted a resolution of intent with regard to a portion of roadway formerly
6 known as Grand Boulevard extending west approximately 390 feet from Lake Whatcom
7 Boulevard, being within the south half of the southeast quarter of the northeast quarter of Section
.8 35, Township 38 North, Range 3 East, W.M.
9 WHEREAS, pursuant to that resolution a public hearing on the issue of whether this
10 roadway should be established as a County road was held on September 15, 1998; and
11 WHEREAS, notice of the public hearing pursuant to RCW 36.81.070 was properly given
12 and proof of such notice was properly demonstrated pursuant to RCW 36.81.080; and
13 WHEREAS, in conjunction with the hearing the County Council received and reviewed
14 the report of the County Road Engineer on the efficacy of the establishment of this portion of
_5 roadway as a County road; and
16 WHEREAS, members of the public have been provided with the opportunity to provide
17 the County Council with information and opinions relating to whether or not this portion of road
18 should become a County road; and
19 WHEREAS, the right -of -way underlying the road belongs to the County; and
20 WHEREAS, in view of the information brought to its attention by staff and members of
21 the public through the hearing process, the County Council finds that establishing the road as
22 a County road is a public necessity and is practicable;
23 NOW, THEREFORE, BE IT ORDAINED that all that portion of Grand Boulevard aka
24 Viewhaven Lane, as shown on the McDougall Lot Line Adjustment, recorded in Volume 36,
25 Page 25 of Short Plats. Said portion extending westerly approximately 390 feet from Lake
26 Whatcom Boulevard within the south half of the southeast quarter of the northeast quarter of
27 Section 35, Township 38 North, Range 3 East of W.M. is hereby established as a County road,
28 effective upon compliance with the Whatcom County Development Standards as to design and
29 construction, including roadway paving and width, and certification of said compliance by the
30 County Engineer. Should said compliance not be completed and certified by October 1, 1999,
31 this Ordinance shall be null and void.
