COMMITTEE ACTION TAKEN.- COUNCIL ACTION TAKEN: 1998 - 134 3/24/98: Introduced 4/7/98: Adopted 7 - 0, Ord. #98 -025 Related File Numbers: #02 -98:ZM Ordinance or Resolution Number (this item only): 1 2 3 SPONSORED BY: cnnGPnt- PROPOSED BY: consent INTRODUCTION DATE: 3/24/98 ORDINANCE NO. 98 -025 AN ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY ZONING MAP FROM RURAL FIVE ACRES (R5A) TO LIGHT IMPACT INDUSTRIAL (LII) FOR APPROXIMATELY 1.6 ACRES IN THE CHERRY POINT - FERNDALE SUBAREA WHEREAS, The Whatcom County Planning and Development Services Department has requested that the Official Whatcom County Zoning Map be amended from Rural Five Acres (R5A) to Light Impact Industrial (LII) for approximately 1.6 acres in the Cherry Point - Ferndale Subarea; and WHEREAS, pursuant to RCW 36.70.590 legal notice was published in the Bellingham Herald on Thursday, February 26, 1998; and WHEREAS, the Deputy SEPA Official determined .in a memorandum dated March 3, 1998 that SEPA requirements have been met by the Draft and Final Environmental Impact Statements prepared in conjunction with the adoption of the Whatcom County Comprehensive Plan in 1997 and that no further SEPA review is required for the rezone; and WHEREAS, the Planning Commission held a public hearing on the proposed amendment on March 12, 1998 and considered all testimony; and WHEREAS, the Council held a public meeting on April 7, 1998 to consider this matter and approved the Planning Commission recommendation; and WHEREAS, the Council found the amendment in the best interest of the public health, safety, and welfare; and WHEREAS, the.Council has adopted the following Findings and Conclusions: Page 1 FINDINGS 1. The subject property is in Ferndale's Urban Growth Area and is within the Short Term Planning Area. -2. The Whatcom County Council requested that the Planning and Development Services Department initiate rezones of parcels that were approved for comprehensive plan map changes to make -the zoning consistent with the Whatcom County Comprehensive Plan. 3. The subject property is presently vacant and wooded. 4. Surrounding Uses include the 1 -5 right -of -way; a 58 acre partially wooded and partially farmed- parcel in Ag Open Space taxation; a wooded area and a 26 unit mobile home park; a small wooded tract and a single family residence owned by Mr. Hall; a warehouse /light industrial complex; and undeveloped Light Impact Industrial zoned land divided into numerous parcels under the Grandview Light Industrial Park General Binding Site Plan. 5. The area is presently served by individual wells and septic systems, with the potential for limited quantities of industrial consumptive water and potable water provided by Whatcom County Public Utility District No. 1. Ferndale's Comprehensive Plan assumes that the area will be served by City utilities within the planning period (by 2015) although Ferndale's six year capital facilities plan does not include any project to extend utilities to this area. 6. Fire protection is provided by Whatcom County Fire Protection District Number 7 which has a mutual aid agreement with the City of Ferndale. The nearest fire station is approximately one -half mile south and one -half mile east, at Grandview and Enterprise Roads. 7. The subject property is adjacent to Portal Way which is a rural major collector and is constructed to all- weather standards. 8. Although the Soil Survey maps indicate prime agricultural soils on the site the small size and constrained location make it unsuitable as part of the agricultural resource land base. 9. The site is flat with no significant hydrologic features, wetlands or wildlife habitat. 10 Whatcom County Comprehensive Plan goals and policies address consideration of locational and market factors and required quantities of land; sufficient and appropriately located residential, commercial, and industrial lands; increasing Page 2 light industrial uses along the Interstate -5 corridor; channeling growth to areas where adequate services can be provided; encouraging provision of serviced industrial sites by cities; ensuring adequate land supply to accommodate twenty years of growth within urban areas; preventing sprawl and promoting phased development from the urban core outward; distinguishing areas where final plans for urban services are not yet in place; assuring that adequate capacity in public facilities exists or is projected within ten years to servethe urban growth areas; and the need to provide serviced industrial land in Ferndale's Urban Growth Area. 11. An error in the present classification is the rural zoning inside an Urban Growth Area. 12. A changed condition is Inclusion in an Urban Growth Area. CONCLUSIONS 1. In view of the fact that the subject property is in Ferndale's Urban Growth Area and is within the Short Term Planning Area as adopted by Whatcom County, the proposed rezone appears to be appropriate. Further support for this proposal is provided by the goals and policies in the Whatcom County Comprehensive Plan that emphasize providing adequate serviced land for industrial development. Future development utilizing Ferndale sewer and water services will require annexation to the City of Ferndale. . Whatcom County Zoning Map is her amended from Rural . Five Acres (R5A) to Light Impact Industrial (LII) for approximately 1.6 acres in the Cherry Point - Ferndale Subarea, in Section 6, T39N, R2E, as shown on Exhibit "A" (Map), Assessors parcel number 390206 - 118274. Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid.
