Ord. #98 -015 Related File Numbers: #10 -97 :ZT Ordinance or Resolution Number (this item only): File Ref:10 -972M SPONSORED BY: Consent PROPOSED BY: Council INTRODUCTION DATE: 2/24/98 ORDINANCE NO. 98 -015 AN INTERIM ORDINANCE ADOPTING ZONING OVERLAY MAPS TO IMPLEMENT THE SHORT TERM PLANNING AREAS DESIGNATED IN THE OFFICIAL WHATCOM COUNTY COMPREHENSIVE PLAN. WHEREAS, the 1990 State Growth Management Act as amended requires the County to adopt a comprehensive plan and development regulations that are consistent with and implement the comprehensive plan on or before July 1, 1994, with a six -month extension on the adoption of development regulations allowed;•and WHEREAS, Whatcom County adopted a Comprehensive Plan on May 20, 1997 following a lengthy public process; and WHEREAS, in order to find compliance with the Growth Management Act, amendments to the Official Whatcom County Zoning Map, implementing new land use direction proposed in the Comprehensive Plan are necessary; and WHEREAS, Whatcom County adopted interim Short Term Planning Area zoning overlay maps under Emergency Ordinance No. 97 -025 which became law on May 22, 1997, and Interim Ordinance 97 -038; which became effective July 15, 1997; and WHEREAS, Interim Short Term Planning Area zoning overlay maps were re- adopted by the Whatcom county Council on January 13, 1998 for a 60 day period that will expire on March 13, 1998; and WHEREAS, The Whatcom County Council has forwarded the Short Term Planning Area Overlay Maps to the Whatcom County Planning Commission to hold a public hearing and any' necessary work sessions and to return a recommendation back to the County Council in time to adopt permanent regulations; and WHEREAS, SEPA requirements have been met by the Environmental Impact Statements and associated documentation prepared in conjunction with adopting the Comprehensive Plan; and WHEREAS, the Planning Commission conducted a public hearing on September 9, 1997, considered all public input, adopted findings, and recommended approval of permanent Short Term Planning Areas at their December 4, 1997 meeting; and WHEREAS, the County is not prepared to adopt permanent Short Term Planning Area maps at this time, and will require up to 180 days for additional analysis and public review to occur; and Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 �5 J 27 28 29 30 31 32 33 34 35 36 37 38 39 40 WHEREAS, in order to assure continued compliance with the Growth Management Act, continuation of the Short Term Planning Area maps is necessary; and NOW,-THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section 1. That in order to preserve the integrity of the process and directives mandated by the Growth Management Act and pursuant to RCW 36.70A.040, the Short Term Planning Areas as presented in Exhibit A, attached, the adopted Comprehensive Plan Appendix E, Map #s 28 -13, 28 -C, 28 -D, 28 -F, 28 -G, Exhibit B, Revised Map #28 -A, and Exhibit C, Revised Map #28 -H be adopted on an interim basis for 180 days from adoption of this Ordinance or until the effective date of an Ordinance adopting these Short Term Planning Areas on a permanent basis. Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid.
