The Planning, Commission held a public hearing on January 8, 1998 and recommends approval. ORIGINATOR'S RECOMMENDED ACTION: The Director of Planning and Development Services recommends Council adopt the Planning Commission recommendation. Ord. #98 -007 Related File Numbers: Ordinance or Resolution Number (this item only): 0 -Q. � 18' -007 1 SPONSORED BY: Planning__ PROPOSED BY: Council INTRODUCTION DATE: 1/27/98 ORDINANCE NO. 2E-Q07 AN ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY ZONING MAP TO REVISE THE BOUNDARIES OF MINERAL RESOURCE LAND (MRL) SPECIAL DISTRICTS COUNTY -WIDE. WHEREAS, pursuant to RCW 36.70.590 legal notice was published in the Bellingham Herald on December 29, 1997; and WHEREAS, a Mitigated Determination of Non - Significance was issued on December 2, 1997, by the responsible Deputy SEPA Official; and WHEREAS, the mitigating condition required that the County adopt an administrative approval process for surface mining activity prior to the adoption of the amended zoning maps. The administrative approval process was adopted by the County on December 9, 1997; and WHEREAS, the Planning Commission held a public hearing on the proposed amendments on January 8, 1998, and considered all testimony; and WHEREAS, the Planning Commission recommends approval of the staff proposal. WHEREAS, the Council reviewed the Planning Commission recommendation at a regular meeting on February 10, 1998, and after due deliberation approved the matter; and WHEREAS, the Council found the amendments in the best interest of the public health, safety, and welfare; and WHEREAS, the Council has adopted the following Findings and Conclusions: FINDINGS 1. Pursuant to RCW 36.70A.040, the State Growth Management Act as amended requires the County to adopt a comprehensive plan and development regulations that are consistent with and implement the comprehensive plan. Whatcom County responded by adopting a comprehensive plan on May 20, 1997. 2. Revised development regulations consistent with the MRL Comprehensive Plan policies were adopted by the County on December 9, 1997. The development regulations now Page 1 include an administrative approval process for surface mining proposals within the MRL Special District. 3. The Whatcom County Comprehensive Plan prioritizes the amendment of MRL Districts for consistency with Plan policies and map designations. 4. The Comprehensive Plan requires that MRL zoning be consistent with MRL Plan designations and under the structure of the zoning code requires this for conservation -purposes in the Rural zones. CONCLUSION The proposed amendments are consistent with the Whatcom County Comprehensive Plan, implementing the first part of Action Plan item #4, Mineral Resources. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section- 1. The Interim Mineral Resource Lands Special District zoning is hereby repealed. The interim MRL's are replaced by the creation of permanent Mineral Resource Lands Special Districts amending the Official Whatcom County Zoning Map as shown in Attachment A. Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid.
