SPONSORED BY: Consent PROPOSED BY: Council INTRODUCTION DATE: 12/9/97 1 ORDINANCE NO. 98 -001 2 AN EMERGENCY ORDINANCE ADOPTING ZONING OVERLAY MAPS TO IMPLEMENT 3 THE SHORT TERM PLANNING AREAS DESIGNATED IN THE OFFICIAL WHATCOM 4 COUNTY COMPREHENSIVE PLAN. 5 6 WHEREAS, the 1990 State Growth Management Act as amended requires the County 7 to adopt a comprehensive plan and development regulations that are consistent with and 8 implement the comprehensive plan on or before July 1, 1994, with a six -month extension on the 9 adoption of development regulations allowed; and 10 11 WHEREAS, Whatcom County adopted a Comprehensive Plan on May 20, 1997 12 following a lengthy public process; and 13 14 WHEREAS, in order.to find compliance with the Growth Management Act, amendments 15 to the Official Whatcom County Zoning Map, implementing new land use direction proposed in 16 the Comprehensive Plan are necessary; and 17 18 WHEREAS, Whatcom County adopted interim Short Term Planning Area zoning overlay 19 maps under Emergency Ordinance No. 97 -025 which became law on May 22, 1997, and 20 Interim Ordinance 97 -038, which became effective July 15, 1997; and 21 22 WHEREAS, The Whatcom County Council has forwarded the Short Term Planning Area 23 Overlay Maps to the Whatcom County Planning Commission to hold a public hearing and any 24 necessary work sessions and to return a recommendation back to the County Council in time to 25 adopt permanent regulations; and 26 27 WHEREAS, SEPA requirements have been met by the Environmental Impact 28 Statements and associated documentation prepared in conjunction with adopting the 29 Comprehensive Plan; and 30 31 WHEREAS, the Planning Commission conducted a public hearing on September 9, 32 1997, considered all public input, adopted findings, and recommended approval of permanent 33 Short Term Planning Areas at their December 4, 1997 meeting; and 34 35 WHEREAS, Interim Ordinance 97 -038 will expire on January 15, 1998; and 36 37 WHEREAS, the County is not prepared to adopt permanent Short Term Planning Area 38 maps at this time, and will require up to 60 days for additional analysis and public review to 39 occur; and 40 41 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 '5 _6 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 WHEREAS, in order to assure continued compliance with the Growth Management Act, continuation of the Short Term Planning Area maps is necessary; and WHEREAS, based on the above findings, the Whatcom County Council declares that an emergency ordinance is necessary for preservation of the public peace, health, safety and. welfare. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section 1. That in order to preserve the integrity of the process and directives mandated by the Growth Management Act and pursuant to RCW 36.70A.040, the Short Term Planning Areas as presented in Exhibit A, attached, the adopted Comprehensive Plan Appendix E, Map #s 28 -13, 28 -C, 28 -D, 28 -F, 28 -G, Exhibit B, Revised Map #28 -A, and Exhibit C, Revised Map #28 -H be adopted on an emergency basis for sixty days from adoption of this Ordinance or until the effective date of an Ordinance adopting these Short Term Planning Areas on a permanent basis. Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid.
